Description

On December 11, 2025 around 8:30 PM, Patrolman Steven Ferlisi with the Colts Neck Police Department responded to a report of a vehicle being driven erratically on Route 34. He eventually located a green 2011 Honda CR-V that was pulled over on the shoulder of Route 34 in the vicinity of Pegasus Drive. At this time, he exited his patrol car to make contact with the driver, and noticed that she was asleep at the wheel. While she was asleep, while her foot was on the brake and the vehicle was still in drive.

The driver of the Honda, eventually identified as Erin Cutillo, told him that she was headed back home. Despite the odor of alcohol, she denied consuming any alcohol earlier that evening. Based on his suspicion of impairment, he called for Patrolman Alexander Kapp to arrive on scene and assist. Once Patrolman Kapp arrived on scene and he ran her information, Erin was asked to exit the vehicle and perform field sobriety exercises. During their interaction, she repeatedly name dropped Patrolman Matt Menosky with the Holmdel Township Police Department.

Patrolman Ferlisi started with the Horizontal Gaze Nystagmus (HGN) test. During the HGN test, he observed the lack of smooth pursuit, distinct and sustained nystagmus at maximum deviation, and the onset of nystagmus prior to 45 degrees. The second exercise was the Walk and Turn test. During the Walk and Turn test, Erin failed to touch heel-to-toe on each step and failed to turn after 9 steps one direction. The final exercise was the One Leg Stand test. During the One Leg Stand test, Erin failed to raise her foot in the proper fashion and put her foot down before the test was complete.

Based on the caller’s report of her erratic driving, the odor of alcohol, and her inability to satisfactorily perform the field sobriety exercises, Erin was placed under arrest for operating under the influence. She was handcuffed and placed inside the patrol car. Her vehicle was impounded by for a mandatory 12-hour hold under John’s Law.

Erin was transported to the Colts Neck Police Department for further processing. The Standard Statement for Motor Vehicle Operators was read to her, and she agreed to submit breath samples. On one of her attempts to submit breath samples, the results indicated an EC result of 0.192% and an IR result of 0.203%, which was more than double the legal limit of 0.08%. However, she failed to submit 2 adequate breath samples so she was still charged with a refusal. Once they finished processing her, Erin was eventually released to Mindy Musillo pending her court appearance after she signed the Potential Liability Warning form on Erin’s behalf.

Erin was issued the following citations:
-Operating under the influence (39:4-50)
-Reckless driving (39:4-97)
-Refusal to submit to chemical test (39:4-50.4A)

The New Jersey Supreme Court has previously affirmed in Salzano v. Central Jersey Media Group, 993 A.2d 778 (2010) that “The fair-report privilege reflects the judgment that the need, in a self-governing society, for free-flowing information about matters of public interest outweighs concerns over the uncompensated injury to a person's reputation.” This video advances a compelling public interest. The summary of events was based on records that are “open to public view through open access to public records” as defined in the Salzano case. In Ramos v. Flowers, 429 N.J. Super. 13, the Appellate Division of the Superior Court has also affirmed the right to film law enforcement interactions.
