Description

Three women. A coordinated shoplifting operation at Walmart. Two inside passing unpaid merchandise — one waiting in the parking lot to load it into the car. Loss prevention had the whole scheme on camera before officers even arrived.

When officers approached the woman in the parking lot, she walked away from them. Then announced she was calling 911. On the officers. While being detained.

⚖️ Legal Analysis Includes:
- New Jersey Title 2C:20-11 — Shoplifting statute: the passing scheme provision and penalty grades
- Terry v. Ohio — reasonable suspicion and the limits of investigatory detention
- Miranda v. Arizona — when the warning is actually required and when it is not
- Graham v. Connor — use of restraint during an active investigation
- Detention vs. formal arrest — the legal distinction officers documented on camera
- New Jersey stop-and-identify law — what officers can and cannot require

📋 Case Outcome: Adele Johnson issued a complaint summons for shoplifting and released at scene, consistent with a disorderly persons charge under N.J. Stat. § 2C:20-11. The receipt she disclosed may have kept the charge at the lower grade.

🎬 Story Breakdown:
- The Scheme: Two subjects inside passing merchandise to the third waiting in the parking lot — loss prevention documented the full operation before officers arrived
- The Arrest: The parking lot subject physically pulled away from officers, escalating a routine detention into a handcuffed patrol car situation — all on bodycam
- The Grades: The primary officer, Sergeant Fabio, the subject, and Walmart LP all graded separately. The scores may surprise you.
