On May 7, 2026, law enforcement officers responded to a reported verbal altercation near Port O’ Pints in Crescent City, California. According to the California Highway Patrol arrest report, a Crescent City police sergeant initially located the reported suspect across the street at a Shell gas station and then observed him run back toward the bar and enter a black Chevrolet Silverado. The report states that officers later observed the Silverado traveling east on Harding Avenue. A Del Norte County sheriff’s sergeant reportedly recognized the suspect driving the truck based on previous contacts. Officers followed the vehicle into a nearby parking lot and initiated an enforcement stop. During the investigation, the driver gave conflicting explanations about who had been operating the Silverado. He first claimed that his niece had been driving but later reportedly stated that nobody was driving the truck. A CHP officer reported observing red and watery eyes, slurred speech and a strong odor of alcohol coming from the driver’s breath and person. The driver allegedly admitted consuming two alcoholic beverages at Port O’ Pints and rated the effects of the alcohol as a three on a scale of one to ten. During field sobriety testing, the officers observed several signs of possible alcohol impairment, including a lack of smooth eye pursuit, sustained nystagmus, eyelid tremors and an inaccurate internal estimate of time during the modified Romberg test. At approximately 10:14 p.m., the driver provided one preliminary breath sample that reportedly registered 0.166%. A 0.166% breath-alcohol reading is more than twice California’s legal limit of 0.08%. Officers attempted to obtain additional samples but were unable to capture another valid reading. The driver was arrested and because officers were unable to obtain a usable evidentiary breath sample, he was transported to Sutter Coast Hospital, where a blood sample was collected and submitted to the California Department of Justice for testing. The Police report states that the California Department of Corrections and Rehabilitation authorized an arrest under California Penal Code 3056 for an alleged violation of parole conditions. CHP recommended an additional charge under Vehicle Code 23152(b) if the pending blood test confirmed a blood-alcohol concentration of 0.08% or higher. After the hospital blood draw the driver was booked into the Del Norte County jail on the following charges: CVC 23152(a) — Driving under the influence of alcohol PC 3056 — Alleged violation of parole conditions CVC 23152(b) — Recommended pending chemical blood-test results California Highway Patrol Officers involved: Officer Urteaga ID - 23445 Officer D.
