The time was 11:13 PM on July 19, 2024. He worried the driver was avoiding the check. So, he stopped the car. The driver was Philip LaRocca. Philip said he was going home. He had been at a birthday party. The party was at The Sandbox in Highlands. He had two drinks earlier. Patrolman Finnegan smelled alcohol. He saw other signs Philip might be impaired. He called for Patrolman Matthew Golembieski. A Sergeant arrived. He first gave Philip the HGN test. Philip's eyes did not move smoothly. They jumped at the farthest points. They also jumped before reaching the maximum angle. Vertical nystagmus was also seen. Next was the Walk and Turn test. Philip did not step heel-to-toe. He turned the wrong way. He also lost his balance. The final test was the One Leg Stand. Philip did not lift his foot correctly. He also did not count properly. His eyes also failed to focus on the object. Philip was arrested for DUI. This was due to the traffic stop. He smelled of alcohol. He failed the tests. His car was impounded. It faced a 12-hour hold under John's Law. He was taken to the police station. At the station, Philip was read a statement. He first agreed to breath tests. He became uncooperative. Officers tried five times for a 20-minute watch period. He refused the test. He was charged with refusal. After paperwork, Philip's attorney picked him up. The attorney signed the statement for him. Philip received several tickets. These included DUI, breath sample refusal, improper U-turn, reckless driving, and careless driving. Court records show the DUI charge was dropped. This was on February 20, 2025.
