On November 12, 2023, Las Cruces Police received a call from the clerk at a Circle K gas station. The clerk stated that a vehicle drove up to the gas pump and just sat there for over 30 minutes. The clerk asked the police to perform a welfare check on the driver. When Sgt. Chavez arrived, he discovered the female driver passed out behind the wheel. He was eventually able to wake her up, but she quickly developed an attitude. When an open container of alcohol was observed in the vehicle, the woman was asked to exit the vehicle to perform standardized field sobriety tests (FSTs). She refused to submit to testing and she was immediately placed under arrest. She also refused to submit to breath alcohol testing. She was arrested for aggravated DUI (2nd offense) and having an open container of alcohol in her vehicle. All suspects are presumed to be innocent until proven guilty in a court of law.
