A late-night traffic stop for erratic driving quickly escalates as an officer suspects impairment, leading to a detailed roadside investigation. At approximately 4:18 AM, a deputy initiated a traffic stop on a vehicle observed driving erratically, including crossing the center line and nearly rear-ending another car. The 20-year-old female driver explained she was new to the area and following maps to her sister's house, initially denying alcohol consumption. However, the deputy detected the odor of alcohol and noted the driver's incoherent demeanor and a lack of smooth pursuit in her left eye, prompting further inquiry. The driver then admitted to consuming a Budlight Seltzer a couple of hours prior. Based on these indicators, backup was requested, and the driver was offered voluntary field sobriety exercises. During the Horizontal Gaze Nystagmus (HGN) test, the deputy observed distinct signs of impairment in both eyes. The subsequent Walk and Turn test showed the driver taking nine steps forward but failing to turn properly, instead walking backward for the second set of nine steps. In the One Leg Stand exercise, she struggled to maintain balance and counted to 22 during a 30-second period. Following these exercises, a preliminary breath test (PBT) indicated a blood alcohol content (BAC) of 0.125%. Consequently, the driver was placed under arrest for driving under the influence and transported to the county jail. After waiving her constitutional rights, she admitted to driving while impaired, and a subsequent breathalyzer test at the facility registered a BAC of 0.111%, exceeding both the adult and underage legal limits. She was later cited for DUI, posted bail, and eventually pleaded guilty to an amended charge of negligent driving in the first degree, receiving a sentence including probation, community service, and a substantial fine. --- Transparency through the lens of the law.
