An evening traffic stop for erratic driving quickly escalates into a complex DUI investigation involving field sobriety tests and legal rights. On April 23, 2022, Patrolman Braswell initiated a stop after observing a 2013 BMW driving erratically on Route 36. The driver, a woman, exhibited slurred speech and seemed unaware of why she had been pulled over for failing to maintain her lane. This initial interaction raised immediate concerns about her sobriety, leading the officer to request supervisory assistance for further evaluation. Upon the arrival of additional officers, including a supervisor, the interaction intensified as field sobriety tests were administered. Officers also noted damage on the passenger side of the vehicle's front bumper, adding another layer to the investigation. During the Horizontal Gaze Nystagmus (HGN) test, specific signs of impairment were observed, including a lack of smooth pursuit. Subsequent tests, the Walk and Turn and One Leg Stand, further revealed the driver's difficulties with balance and following instructions, despite her successful completion of a verbal alphabet test. Based on the accumulated evidence from her erratic driving, the observed vehicle damage, and her performance on the field sobriety exercises, the driver was placed under arrest for driving under the influence. The incident then moved to the police headquarters for processing. During a mandatory observation period, the driver invoked her Miranda rights, choosing not to answer any questions, and subsequently refused to submit to a chemical breathalyzer test, a critical piece of evidence in DUI cases. Following processing, she was released with multiple summonses, including charges for driving while intoxicated, refusal to submit to chemical testing, failure to maintain a lane, operating an uninsured out-of-state vehicle, and reckless driving, highlighting the significant legal consequences of the encounter. --- Transparency through the lens of the law.
