#news #police #arrest #cops Report: On 01/08/2022, Officer was on patrol in the downtown area when he heard a vehicle revving the engine. Officer then saw a black motorcycle ride by and identified that that was the loud vehicle. Officer continued to hear the motorist revving the engine he was at the stoplight. Then turned right. At that stoplight he could still hear the motorist revving the engine. When the officer turned he saw the motorist laying drags at the stoplight. The bike was stopped and the back tire was spinning causing the back of the bike to sway side to side. At that time, the officer got behind the vehicle to make a traffic stop. Officer came up to the motorist and identified and asked what he was doing. The suspect replied that he was going home. Officer noticed the suspects eyes close for a brief period of time while the officer was talking to him. The officer then asked how much he had to drink and the suspect stated that he had one beer. When the suspect took off his helmet and started talking the officer smelled the odor of an alcoholic beverage on his breath. Therefore, the officer asked the suspect if he would take some voluntary field test to make sure he was okay to drive and the suspect stated yes. Because of the terrain they relocated to level ground and the suspect began the test. Here are the clues that the officer noticed as follows. ● HGN ● Lack of Smooth Pursuit ● Distinct and sustained nystagmus max deviation ● Onset of nystagmus prior to 45 degrees Walk and Turn ● Can't keep balance while listening to instructions ● Starts before instructions are finished ● Stops walking to steady self ● Does not touch heel-to-toe ● Loses balance while walking (Steps off Line) ● Uses arms for balance (raises arms over six inches) ● Loses Balance while turning, turns incorrectly ● Incorrect number of steps One Leg Stand ● Sways while balancing ● Uses arms to balance (raises arms over six inches) ● Hopping ● Puts foot down ● Cannot do tests (put foot down three times). After gathering the clues the officer then placed the suspect under arrest for driving under the influence of alcohol. Officer then read the suspect implied consent and he didn't want to cooperate with answering the question of would he submit to the state test. The officer continued to ask the officer questions. Because the suspect didn't answer the question the officer perceived it to be a refusal. The suspect was search incident to arrest and no contraband was found. The suspect was transported to the Clarke County Jail and turned over to deputies without further incident. The suspects motorcycle was towed.
