On May 5, 2025, University of Wisconsin - Madison Police Sergeant Mulvey was flagged down by Madison Fire Department personnel after an apparently intoxicated driver nearly struck an ambulance. Sgt. Mulvey located the vehicle in question and initiated a traffic stop. The vehicle was being driven by a 31-year-old woman. The woman denied consuming alcohol, but Sgt. Mulvey felt the woman was acting unusual, so he instructed the woman to exit her vehicle in order to perform standardized field sobriety tests. This included a portable breath test (PBT), which registered 0.27% BAC. The woman was placed under arrest and she was read the Wisconsin Implied Consent Law. She initially agreed to provide an evidential breath test. However, once she was at the police station, she did not recall giving consent. As a result, Sgt. Mulvey applied for and was granted a blood warrant. The woman was transported to the hospital, where the blood draw occurred. She was then transported to the Dane County Jail, where they had her submit to a PBT. That test registered 0.29% BAC. As the result, corrections officers refused to accept the woman until she received medical clearance from the hospital. She was transported back to the hospital once again. Eventually, she was taken back to the jail. Her charges and the outcome of her case are discussed at the end of the video.
