He activated his lights to pull the car over. The driver stopped close to the UGA Softball Stadium entrance. Officer Davis approached and spoke with the driver and her passenger. The driver said she didn’t have her driver’s license. She was later identified as 20-year-old Rachel Ferguson, and her passenger was named Elizabeth Coffin. Officer Davis told Rachel that he saw her commit several traffic violations. While talking to her, he caught the smell of alcohol on her breath. Rachel explained she was on her way home after picking up a friend downtown Athens. Officer Davis asked her to step out of the vehicle. Since he still smelled alcohol on her, he asked her to do some field sobriety tests. The first test was the Horizontal Gaze Nystagmus (HGN). He watched for signs of impairment and saw that her eyes didn’t move smoothly, that there was distinct nystagmus at maximum deviation, and that nystagmus started before 45 degrees. She did not show vertical nystagmus. The next test was the Walk and Turn. During this test, Rachel failed to touch heel-to-toe as instructed and took too many steps. The third test was the One-Leg Stand. She didn’t follow instructions and, instead of lifting her foot, she took long steps. Because of her shaky driving, the smell of alcohol, and her poor performance on the tests, Rachel was arrested for DUI. After arresting her, Officer Davis read her the Georgia Implied Consent Notice. She agreed to give breath samples. She was taken to a station where Sergeant Dieball conducted the breathalyzer test. During the test, she told the sergeant she worked as a bartender at Moonshine Bar & Grill. The test results showed her BAC was 0.161%, more than twice the legal limit of 0.08% for drivers over 21. Rachel was then taken to Clarke County Jail for booking. On the way, another officer called in to say she found a fake ID inside her vehicle. Rachel received two tickets: one for DUI—Alcohol under 21 and one for failing to stay in her lane. 0:58 The very first thing she says to this cop my real... 1:07 3 hits on the bingo card 5:35 is she for real.
