As he approached the 2018 Nissan Rogue, he saw that its airbag had deployed. The passenger-side tire and rim had also suffered major damage after striking nearby rocks. Officers Nicolas Bagan and Samuel Forre, along with Sergeant Gregory Penn, arrived shortly afterward. The driver, 31-year-old Yanell Barrientos, said she had trouble making the right turn from Mountain Avenue onto Raymond Street. She also told Officer Went that she had consumed three drinks at a restaurant before attempting to drive home. The Westfield Fire Department arrived to check Yanell, but she declined medical treatment. Believing she might be impaired, Officer Went asked her to complete field sobriety tests. Sergeant Penn and Officer Bagan assisted during the testing. Yanell was first asked to recite the alphabet from D through W. Instead, she began with C and continued through Z. Officer Went and Officer Fourre then administered the Horizontal Gaze Nystagmus test twice. They observed a lack of smooth eye movement, clear and sustained shaking when her eyes moved to the side, and shaking that began before her eyes reached 45 degrees in either direction. During the Walk and Turn test, Yanell failed to walk heel-to-toe, held her arms out, and did not stay on the yellow lines. On the One Leg Stand test, she struggled to keep her foot raised, swayed, and put her foot down several times. Officer Went arrested Yanell for driving under the influence. He based the decision on the damaged vehicle, her unclear statements, and her poor performance on the sobriety tests. Yanell briefly resisted, but Sergeant Penn was able to handcuff her. Officer Went placed her in the patrol car. Officer Fourre remained at the scene until the Nissan was towed for the mandatory 12-hour hold required under John's Law. Officer Went brought Yanell to Westfield Police Headquarters, where Lieutenant Nicole Stivale searched her. Officer Bagan read her the Standard Statement for Motor Vehicle Operators, and Yanell agreed to provide breath samples. The Alcotest recorded a blood alcohol concentration of 0.14%, exceeding the legal limit of 0.08%. During processing, Yanell admitted that she had been drinking at Stage House Tavern in Mountainside. Afterward, a sober person took custody of her and signed the Potential Liability Warning form. Officer Went issued three summonses for operating under the influence, reckless driving, and careless driving. Court records show that Yanell was convicted of operating under the influence on July 28, 2022. She received a $790 fine and lost her driver's license for three months. She also completed 12 hours at an intoxicated-driver resource center. Under her plea agreement, the reckless-driving and careless-driving charges were dismissed.
