Please like, comment, and SHARE! 🙏 🔍 Episode Overview: At approximately 10:43 PM on December 4, 2023, a member of staff at the QuickChek situated at 29 Jackson Avenue contacted the Pequannock Township Police Department to report an incident involving a visibly intoxicated woman inside her vehicle in the parking lot. The witness stated that the driver had hit the curb while entering the parking area and appeared unsteady while moving around the lot. Upon arrival at the scene, Patrolman Brian Parigi observed a gray 2013 Kia Optima, matching the witness's description, failing to signal during a left turn onto Jackson Avenue, in violation of 39:4-126. As the patrolman followed the vehicle, he noted the driver unnecessarily applying the brakes several times, thus causing a potential traffic delay or even an accident as per violation 39:4-56. Upon the abrupt left turn onto Sage Road, Patrolman Parigi activated his emergency lights in an attempt to initiate a traffic stop. The driver, however, continued driving before eventually stopping near the intersection of Elm Road and Kenmore Road. After coming to a stop, Patrolman Parigi approached the vehicle to make contact with the driver, identified as 19-year-old Laura. Shortly thereafter, Sergeant James Dericks and Patrolman Stephen Knatz arrived on the scene to assist with the traffic stop. Laura was requested to exit the vehicle and stated she was heading home, denying any alcohol consumption. Due to Patrolman Parigi's suspicion of impairment, Laura was asked to perform field sobriety exercises. During the evaluation, Laura encountered difficulties with the exercises. Specifically, she struggled with reciting the alphabet from “B” to “K” in the correct sequence and counting backwards from 52 to 36. Furthermore, the Horizontal Gaze Nystagmus (HGN) test revealed observable nystagmus at maximum deviation, onset of nystagmus prior to 45 degrees, and vertical gaze nystagmus in both eyes. During the Walk and Turn test, Laura failed to maintain proper form and took an incorrect number of steps. Lastly, in the One Leg Stand test, she encountered challenges while attempting to raise her foot in the designated manner, count as instructed, and maintain her balance. Based on the witness statement, Laura was placed under arrest for driving under the influence by Patrolman Parigi due to her erratic driving, the odor of alcohol, and her inability to adequately complete the field sobriety exercises. Her vehicle was impounded for a mandatory 12-hour hold under John’s Law. Initially, Patrolman Parigi transported her to the Riverdale Police Department for the administration of the Alcotest. At the Riverdale Police Department, Laura was informed of the Standard Statement for Motor Vehicle Operators and consented to provide breath samples for testing. The Alcotest machine was operated by Riverdale Police Sergeant Andrew Duffy. Her test results revealed a BAC of 0.23%, which exceeded the legal limit of 0.08% for drivers over 21 by nearly threefold and surpassed the legal limit of 0.01% for drivers under 21 by 23 times. After being taken back to the Pequannock Township Police Department, Laura underwent further processing and was subsequently released to her mother once the Potential Liability Warning Form was signed on her behalf. She was cited for the following offenses: operating under the influence, reckless driving, delaying traffic, and failure to give proper signal.
