Avila observed a vehicle make an illegal turn. He initiated a traffic stop and the female driver attempted to hand him the driver's license of the passenger. The driver was removed from the vehicle and admitted to consuming alcohol. She was requested to perform standardized field sobriety tests (FSTs), but blamed her inability to complete the tests on a previously broken leg. She submitted to a preliminary breath test (PBT) and the result was 0.11% BAC. She was placed under arrest for her 2nd DUI. It turns out she also had a warrant for her arrest. When Lt. Avila read her the informed consent law, she became defiant and argumentative. Lt. Avila considered her failure to cooperate to be a refusal and he sought a warrant for a blood draw. Upon arrival at the hospital, the woman become increasingly aggitated and combative. It look 5 police officers and several hospital security guards to get the blood draw completed. The antics continue when she arrives at the Dane County Jail. All of the charges discussed in the video are still pending as her first court appearance is not scheduled until December 4, 2023. All suspects are presumed to be innocent until proven guilty in a court of law.
