Around 2:06 AM on September 15, 2024, Patrolman John Mania with the Middletown Township Police Department responded to the scene of a motor vehicle crash on Hubbard Avenue. Dispatch advised him that a hysterical female had reported that she struck a pole. Upon arrival, Patrolman Mania noticed that a white 2020 Ford Explorer had struck a utility pole and sustained severe front-end damages. There was airbag deployment inside the vehicle. He made contact with 23-year-old Savannah, who was identified as the driver of the Ford Explorer. Savanna told Patrolman Mania that she had been at her friend’s place in Red Bank earlier that evening. When he asked her if she had anything to drink, she initially admitted to consuming alcohol a few hours prior, but she would later admit to probably consuming alcohol even later in the evening. Patrolman Allen arrived on scene shortly afterwards to take the motor vehicle accident report. Based on Patrolman Mania’s suspicion of impairment, Savannah was asked to perform field sobriety exercises. The first exercise was the Horizontal Gaze Nystagmus (HGN) test, and Patrolman Mania observed a lack of smooth pursuit, distinct and sustained nystagmus at maximum deviation, and the onset of nystagmus prior to 45 degrees. No vertical gaze nystagmus was observed. The second exercise was the Walk and Turn test. During the Walk and Turn test, Savannah failed to touch heel-to-toe on each step and turned improperly. The final exercise was the One Leg Stand test, and Savannah failed to raise her foot in the proper fashion and put her foot down multiple times before the test was complete. Based on the motor vehicle crash, the odor of alcohol on her person, and her inability to adequately complete the field sobriety exercises, Patrolman Mania placed Savannah under arrest for driving under the influence. Her vehicle was impounded for a mandatory 12-hour hold under John’s Law. She was transported by Patrolman Mania to Middletown Township Police Headquarters for further processing. At police HQ, Savannah was read the Standard Statement for Motor Vehicle Operators and agreed to submit breath samples for testing. Lieutenant Brian Dilworth administered the Alcotest machine. Her Alcotest results indicated a BAC level of 0.139%, which was nearly double the legal limit of 0.08%. After they were finished processing her, Savannah was eventually released to her mother after she signed the Potential Liability Warning Form on Savannah’s behalf. Around the time she was being released, she referred to Patrolman Mania and Sergeant Jason Troshane as “f***ing losers.” She was issued the following summonses: Operating under the influence, careless driving, reckless driving, and traffic on marked lanes ---------------------------------------------- Please LIKE, SUBSCRIBE, and consider supporting this channel (email us for more information). (P.L. 2024, c.16). Defendants are considered innocent until proven guilty. The New Jersey Supreme Court has previously affirmed in Salzano v. North Jersey Media Group, 993 A.2d 778 (2010) that “The fair-report privilege reflects the judgment that the need, in a self-governing society, for free-flowing information about matters of public interest outweighs concerns over the uncompensated injury to a person's reputation.” This video advances a compelling public interest. The summary of events was based on records that are “open to public view through open access to public records” as defined in the Salzano case. In Ramos v. Flowers, 429 N.J. Super. 13, the Appellate Division of the Superior Court has also affirmed the right to film law enforcement interactions.
