Per Police Report: On March 15, 2023, while patrolling east on Northlake Blvd. west of State Road 710, I observed a small gray vehicle driving on the right shoulder in the grass traveling west on Northlake Blvd. I made a U-turn and pulled in behind the vehicle, now known to me as a Rivian Electric Vehicle. As I approached the vehicle to initiate a traffic stop, the vehicle was still observed driving on the shoulder entirely. The probable cause for my lawful traffic stop was a vehicle driving off the paved travel lanes, traveling on the grass shoulder not designed for vehicular traffic. The vehicle stopped immediately upon me turning on my emergency equipment, and I pulled onto the right shoulder behind the Rivian. I contacted the driver, now known to me as John Edwin Andio. I walked up and contacted Andio and asked what he was doing and informed him he was driving on the grass. Andio displayed slow deliberate movements that, based on my experience, are possible for an impaired driver. Andio’s speech was slow and slightly slurred, eyes seemed droopy. After discussing with my supervisor and notifying Lake Worth Communications Center (LWCC) of the stop and providing the necessary information, I walked back and spoke with Andio again. I asked him to step from his vehicle, and he complied. Once at the rear of the vehicle, I asked if he had taken any medication, and he informed me he took Trazodone as a sleep aid around 05:30 AM. He stated he had no alcoholic beverages. I informed him I believed he was impaired beyond his normal faculties, and I would like to transport him in my vehicle to the shopping center about 1000 feet away for Field Sobriety Exercises. Andio agreed and was cooperative. Andio was given a brief pat down for weapons and placed in my vehicle and seat belted. While en route, he spoke with someone on his cell phone, and once at the shopping center, he refused all Field Sobriety Tests and Nystagmus. I then informed him he was under arrest, and placed him in handcuffs (checked for tightness and double locked) for violation of FLA STAT § 316.193 (1), refusal, and suspicion of driving under the influence. On the way back to the scene of the stop, Andio started to bait me into a confrontation by speaking about my family. Ignoring his comments, I advised him of his Miranda Rights because he was uttering continuously on camera. Back at the scene, I asked for a tow truck and a backup unit to step up their response to my location. I asked Andio for his car keys or key FOB to inventory his vehicle incident to arrest. He became uncooperative and would not help me in any way. Andio secured in my vehicle, I performed a walk around of the Rivian and noticed that there was what appeared to be fresh damage to the center hood area above the grill. It appeared as if the vehicle collided with a small fixed object, like a post. Once Kauffs Towing arrived to tow the Rivian, Andio would still not cooperate and let us in his vehicle. The tow truck driver, Travis Munn, tried to explain that he needed to put the Rivian in neutral to load it on the tow truck, and Andio was still uncooperative. Employee of Andio's Company stopped out because he noticed the vehicle and offered to take the vehicle and secure it. Andio refused and told his employee, Kevin, not to take the vehicle. I asked Andio to step out of my vehicle, and he complied. I searched him again for a key FOB, but he did not have one. I then placed Andio in Trooper Easton's patrol vehicle for transport to the Palm Beach County Jail and had the tow truck leave the scene, as well as Andio's employee, Kevin. Andio stated he was okay with leaving his car roadside and locked. Per my supervisor, Mike Leo, stated that was fine but to red tag it, which I did. Andio was able to exit Trooper Easton's vehicle and started to walk on the shoulder. I immediately secured him and placed him in Trooper Easton's vehicle again. Andio would not comply and put his left leg/foot onto Trooper Easton's vehicle door. I tried several times to get his leg into the vehicle, but he actively prevented me from doing so by locking his foot under the door and knee. I then informed Andio he would be charged with FLA STAT § 843.02 (resisting arrest without violence). This video was obtained through Public Records Requests.
