On January 15, 2026 around 4:48 AM, Officer Sean Smith with the Mount Olive Police Department responded to Eagle Rock Village on a report of a woman who was loudly screaming from her car and repeatedly honking her horn. Officer Smith arrived on scene and made contact with a woman who was sitting in the driver seat of a silver 2024 Nissan sedan. As he started speaking with her, he observed indicators of impairment. The suspect, later identified as Elizabeth Moore, admitted to consuming alcohol earlier that evening. She told Officer Smith that she was coming from the Baymont by Wyndham, and she was looking for another man. Based on his suspicion of impairment, Elizabeth was asked to perform field sobriety exercises. The first exercise was the Horizontal Gaze Nystagmus test. The second exercise was the Walk and Turn. During the Walk and Turn test, Elizabeth failed to touch heel-to-toe on each step, turned improperly, and failed to keep her arms at her sides. The final exercise was the One Leg Stand test. During the One Leg Stand test, Elizabeth failed to raise her foot in the proper fashion and put her foot down before the test was complete. Based on her being in physical control of a motor vehicle, her admission to consuming alcohol earlier that evening, and her inability to satisfactorily complete the field sobriety exercises, Officer Smith placed Elizabeth under arrest for driving under the influence. The vehicle was impounded for a mandatory 12-hour hold under John’s Law. Officer Smith transported Elizabeth to the Mount Olive Police Department for further processing. At the Mount Olive Police Department, Elizabeth was read the Standard Statement for Motor Vehicle Operators, and but she refused to submit breath samples. When the officers were finished with processing her, Elizabeth was eventually released pending her court appearance. Officer Smith issued her the following citations: -Operating under the influence (39:4-50) -Refusal to submit to chemical test (39:4-50.4A) -Reckless driving (39:4-96) ------------------------------------------ Please LIKE, SUBSCRIBE, and consider supporting this channel (email us for more information). (P.L. 2024, c.16). Defendants are considered innocent until proven guilty. The New Jersey Supreme Court has previously affirmed in Salzano v. North Jersey Media Group, 993 A.2d 778 (2010) that “The fair-report privilege reflects the judgment that the need, in a self-governing society, for free-flowing information about matters of public interest outweighs concerns over the uncompensated injury to a person's reputation.” This video advances a compelling public interest. The summary of events was based on records that are “open to public view through open access to public records” as defined in the Salzano case. In Ramos v. Flowers, 429 N.J. Super. 13, the Appellate Division of the Superior Court has also affirmed the right to film law enforcement interactions.
