Upon arrival, he found a 2015 Infiniti on the grass with its airbags deployed. He noticed empty wine bottles inside the car, but the driver and passenger were not there. Shortly after, a nearby homeowner informed the officers that they had taken the driver and passenger into their home. Patrolman Giamello then went inside and met the driver, 22-year-old Cecily O’Brien. As he spoke with her, he observed her slurred speech and smelled alcohol on her. Cecily informed the officer that they had come from Philadelphia and were on their way home. Patrolman Giamello inquired whether she had consumed any alcohol, to which she acknowledged drinking vodka earlier that night. Due to his concerns about her impairment, he suggested that Cecily take part in field sobriety tests. Sergeant Laura Paul began the assessment with the Horizontal Gaze Nystagmus (HGN) test. She noted that both eyes showed a lack of smooth movement and distinct nystagmus when fully turned, with the nystagmus starting before reaching a 45-degree angle in the right eye. Next was the Walk and Turn test. During this test, Cecily did not maintain a straight line while walking heel-to-toe and turned on her right foot instead of her left. The final test was the One Leg Stand, where Cecily used her arms to help balance and did not count correctly. Patrolman Giamello arrested Cecily for driving under the influence due to her slurred speech, the smell of alcohol on her, and her failure to perform the field sobriety tests properly. Before putting her in the patrol car, Sergeant Paul conducted a search. Cecily's vehicle was impounded for a required 12-hour hold in accordance with John's Law. Patrolman Giamello then took Cecily to the Evesham Township Police Department for processing. At police headquarters, Cecily was informed of her Miranda rights and the Standard Statement for Motor Vehicle Operators. She chose to waive her Miranda rights and agreed to take breath tests. The results showed her blood alcohol concentration (BAC) was 0.16%, which is twice the legal limit of 0.08%. After completing the processing, she was released to her mother at 1:43 AM on June 24th, after her mother signed the Potential Liability Warning form on her behalf. On October 13, 2022, court records show that Cecily admitted to driving under the influence. She was instructed to complete 12 hours at a resource center for intoxicated drivers, use an ignition interlock device for three months, and pay a total of $790 in fines.
