It really helps us do original reporting like this. 🔍 Episode Overview: At approximately 12:43 AM on April 24, 2023, Officers Bonilla and DeJesus from the Hoboken Police Department arrived at a car accident scene involving a 2019 Mercedes and a 2011 Honda Civic near Washington Street and 13th Street. Officer DeJesus spoke with Katarina and Sara, who were in the Honda that had been hit. Meanwhile, Officer Bonilla talked to Julia, the 25-year-old driver of the Mercedes. Katarina and Sara suggested to Officer DeJesus that Julia might have been drinking, but Julia denied having consumed any alcohol. Officer Bonilla instructed Julia to step out of her car and turn off the engine. As he started to talk to her, he noticed a strong smell of alcohol coming from the vehicle. He also spotted two empty cups on the driver's side door. Julia's eyes looked bloodshot and watery, and her speech was difficult to understand. Suspecting she might be impaired, Officer Bonilla asked her to take some field sobriety tests. At first, Julia denied drinking any alcohol, but she eventually confessed to having consumed some earlier that day. The first test for sobriety was the Horizontal Gaze Nystagmus (HGN) test. Officer Bonilla observed that Julia's eyes did not move smoothly. He noticed a clear and lasting twitch in her eyes when they were turned all the way to the side, and her eyes began to twitch before reaching 45 degrees. However, he did not see any twitching when her eyes moved up and down. Next, they moved on to the Walk and Turn test. During this test, Julia struggled to keep her balance, made a wrong turn, and couldn't walk in a straight line with her heel touching her toe. Finally, they did the One Leg Stand test. In this test, Julia had trouble balancing; she put her foot down multiple times and swayed, using her arms to help steady herself. After the accident, Julia's speech was unclear, and she struggled with the sobriety tests. Due to these signs, Officer DeJesus arrested her for driving under the influence. Officer Protopapadokis searched her car but found no drugs or alcohol, although he noted a smell of alcohol inside. Officers Bonilla and DeJesus then took Julia to the Hoboken Police Department for processing. Sergeant Martinez from Union City arrived to conduct another search, but it revealed no illegal items. Following this, first responders from the Hoboken Volunteer Ambulance Corps checked on Julia, and she decided not to go to the hospital. After the first responders assessed her condition, the officers were set to move forward with their procedures. Sergeant Zeszotarski, who is trained to use the Alcotest machine, informed Julia about the Standard Statement for Motor Vehicle Operators. Julia agreed to take the breath tests. She also chose to give up her Miranda rights and confessed that she had consumed several drinks throughout the evening. Sergeant Zeszotarski performed the Alcotest after watching Julia for 20 minutes. The results showed her blood alcohol concentration (BAC) at 0.23%, which is almost three times the legal limit of 0.08%. After Officer DeJesus took her fingerprints and a photo, Julia was allowed to leave with her cousin, who signed a form acknowledging potential liability on her behalf. Julia received several tickets for operating under the influence, reckless driving, not staying in marked lanes, and assault by auto. On October 4, 2023, Julia faced the consequences of her actions after being found guilty of driving under the influence. As a result of the guilty verdict, she lost her driving privileges for three months. Additionally, she was ordered to complete 12 hours at a program aimed at helping intoxicated drivers. Julia also had to pay fines totaling $640. Alongside this, she received a $202 fine for not staying in her lane. Fortunately, the charges of reckless driving and assault by auto were dismissed due to her plea agreement. 2:20 ish... you have to be drunk 4:24 is she replying to the guy over the radio? 18:00 ummm, are you going to do the t est or what? 19:56 Oh my goodness!
