The caller expressed concern that the situation was worsening and feared the driver might attempt to harm someone with the vehicle. Officers Matthew James and Nathan Anderson arrived on scene within minutes. Officer Anderson first spoke with the reporting witness, who reiterated concerns that the driver, later identified as 53-year-old Melanie Udell, appeared under the influence and had driven in a manner that made the witness fear for his safety. Officer James approached Udell’s vehicle and spoke with her at the driver’s side door for several minutes. The conversation initially appeared calm, but during the interaction, Officer James detected the odor of alcohol and marijuana coming from inside the vehicle. He asked Udell to step out so officers could continue their investigation. Udell refused. Moments later, Udell started the vehicle and suddenly reversed before accelerating forward toward Officer James. He was able to push away from the vehicle and avoid being struck. Udell then backed up again and quickly accelerated a second time, deliberately steering toward the officers. The vehicle struck Officer James, launching him over a nearby snowbank and into a fence. The impact was severe enough that his service firearm was knocked from his hand and landed on the opposite side of the fence. At the same moment Officer James was hit, Officer Anderson fired his duty weapon, striking Udell. Udell’s vehicle came to rest atop the snowbank just feet from where Officer James lay injured, still positioned in the path of the vehicle. Officer James suffered injuries to his head, hands, and leg and was transported to the hospital, where he was later released. Udell was taken to a hospital but was pronounced dead from her injuries. Both officers were placed on administrative leave following the incident, consistent with department policy. Officer James later required knee surgery and is expected to be out of regular duty for an extended recovery period. The North Dakota Bureau of Criminal Investigation reviewed the incident and determined that Officer Anderson’s use of force was justified under the circumstances.
