Trooper's Summary: At 21:14hrs on this date, Marquette City Police Department was dispatched to with reference to a shots fired call. It was reported to dispatch that one subject had sustained several gunshot wounds and was transported to U.P. Health Systems Marquette for medical treatment. Marquette City Officers relayed that the suspect in the shooting was driving a black SUV and was heading towards the hospital. Marquette City Officers also reported the suspect’s first name was “Trevor” and at 21:24hrs dispatch advised the suspect vehicle had a registration of 2MDZ84. At this time, I was leaving the Post and heading eastbound on US-41 towards Marquette. I noted a full-size black SUV turn off the west end of Midway drive and continue westbound on US-41. I turned around to check the vehicle and match the registration plate to the vehicle the suspect in the shooting was driving. As I caught up to the vehicle, I noted it to pass traffic and accelerate. I noted that it was traveling considerably faster than surrounding traffic. Sgt. Oliver was leaving the Post and followed westbound on US-41. I was able to confirm the last three digits “Z84” on the suspect vehicle as we passed the Carp River bridge and noted that speeds at that time were in excess of 90 mph. Dispatch was notified and I activated the emergency lights and siren on my fully marked patrol vehicle. Sgt. Oliver was close behind and started calling out the pursuit after the suspect vehicle failed to pull over and attempted to evade Troopers by accelerating. As we continued westbound on US-41, the suspect vehicle pulled into the eastbound traffic lanes of US-41. Eastbound traffic lanes were empty until we got into Negaunee City by Maas Street. Three vehicles were eastbound on US-41and the suspect vehicle moved into the center turn lane to avoid a collision. When we got to the east end of the parking area of the Krist gas station the suspect vehicle veered into the parking lot at a high rate of speed and crashed into the diesel pumps east of the station (21:28hrs). As a result of the impact the suspect vehicle and diesel pumps were immediately engulfed in fire. I pulled into the parking lot and retrieved my fire extinguisher. As I ran to the crash, I heard Sgt. Oliver addressing the driver of the vehicle ordering the driver to get on the ground and roll away from the burning vehicle. The driver was later identified as Trevor Restivo. Due to the fact that the vehicle and driver (Restivo) were suspect in an attempted murder and shots fired incident shortly before the vehicle was located, the fact that the Restivo took overt actions to avoid law enforcement, drove westbound in the eastbound lanes of US-41 at a high rate of speed and intentionally crashed his vehicle into diesel pumps at a gas station, I drew my Department issued side arm and pointed it at Restivo. I also began to address Restivo providing directions for him to roll away from the fire and toward Sgt. Oliver. Restivo advised no one else was in the vehicle and complied with our loud verbal commands. When Restivo was clear of the fire area, Sgt. Oliver was able to secure his hands, and we moved him further away from the fire to provide first aid. I contacted the gas station employee and requested he shut down the pumps. I pulled my patrol vehicle further away from the fire and went to provide first aid to Restivo. Restivo complained of After searching him, I noted Pressure bandage and rolled gauze were used to bind this wound. Due to the complaint of Restivo was rolled onto his right side. When asked, the driver identified himself as “Trevor”. Restivo started to show signs of shock. EMS arrived to treat Restivo, they were informed of his complaints and observed condition.
