On January 24, 2026, Las Cruces Police Officer Guerrero stopped a vehicle for speeding and failure to stop at a stop sign. The vehicle was being driven by a 26-year-old woman. Officer Guerrero observed several open containers of alcohol on the floorboard but the woman denied consuming alcohol. She was asked to exit her vehicle in order to perform standardized field sobriety tests. After the tests, she was placed under arrest. She was transported to the Las Cruces Police Station, where she agreed to provide breath samples. The first sample registered 0.19% BAC. However, she did not provide sufficient breath for the second sample, so the test was considered a refusal. This elevated her charge to Aggravated Driving While Under the Influence. The outcome of her case is unknown.
