Around 12:26 AM on June 15, 2025, Patrolman Henri Zilliox with the Lambertville Police Department was on patrol and he observed a white 2021 Acura RDX speeding 47 MPH in a 25 MPH zone on Route 165 in the area of Mount Hope Street. He then made a U-turn and activated his emergency lights to initiate a traffic stop. The driver pulled over on South Main Street next to the Riverwalk complex. He exited his patrol car and made contact with the driver, who was identified as 23-year-old Gianna Dina. As Patrolman Bast was speaking with Gianna, he observed indicators of impairment. Patrolman Kevin Bereheiko arrived on scene to assist shortly afterwards. She admitted to the officers that she was coming from a bar in New Hope, Pennsylvania. She also admitted to consuming 2 drinks earlier that evening. Based on his suspicion of impairment, he asked her to exit the vehicle and perform field sobriety exercises. He started by asking her to recite the alphabet from “A” to “Z” without singing it, which she did twice. The second exercise was the One Leg Stand test. During the One Leg Stand test, Gianna failed to raise her foot in the proper fashion while putting her foot down before the test was complete. The third exercise was the Walk and Turn test. During the Walk and Turn test, Gianna failed to touch heel-to-toe on each step, turned improperly, and failed to keep her arms at her sides. The final exercise was the Horizontal Gaze Nystagmus (HGN) test, which was performed by Sergeant Michael Gramlich. During the HGN test, Sergeant Gramlich observed 6/6 indicators of impairment. Based on her excessive speeding, her admission to consuming alcohol earlier that evening, and her inability to satisfactorily perform the field sobriety exercises, Gianna was placed under arrest for operating under the influence. Gianna was transported to the Lambertville Police Department for further processing. Gianna’s friend told Sergeant Gramlich that they were coming from a bar across the Delaware River in New Hope, Pennsylvania. Sergeant Gramlich eventually transported Gianna’s friend to the station to wait for her in the lobby. Gianna’s vehicle was impounded for a 12-hour hold according to John’s Law. At the station, Gianna was read the Standard Statement for Motor Vehicle Operators, and agreed to submit breath samples. Her Alcotest results indicated a BAC level of 0.144%, which was nearly double the legal limit of 0.08%. After the Alcotest was complete, he was eventually released to a sober pending her court appearance after she signed the Potential Liability Warning form on Gianna’s behalf. Gianna was issued the following traffic tickets: -Operating under the influence (39:4-50) -Speeding (39:4-98) ---------------------------------------------- Please LIKE, SUBSCRIBE, and consider supporting this channel (email us for more information). (P.L. 2024, c.16). Defendants are considered innocent until proven guilty. The New Jersey Supreme Court has previously affirmed in Salzano v. North Jersey Media Group, 993 A.2d 778 (2010) that “The fair-report privilege reflects the judgment that the need, in a self-governing society, for free-flowing information about matters of public interest outweighs concerns over the uncompensated injury to a person's reputation.” This video advances a compelling public interest. The summary of events was based on records that are “open to public view through open access to public records” as defined in the Salzano case. In Ramos v. Flowers, 429 N.J. Super. 13, the Appellate Division of the Superior Court has also affirmed the right to film law enforcement interactions.
