Around 6:30 PM on July 29, 2023, Officer John Roskos of the Rio Rancho Police Department observed a white 2022 Nissan traveling 70 MPH in a 40 MPH zone on Southern Boulevard. He began pursuing the vehicle and closed the gap near the intersection of Southern Boulevard and Golf Course Road. The officer activated his emergency lights to initiate a traffic stop, but the vehicle did not stop until Country Club drive and pulling in to the Bank of America parking lot. Once the vehicle was stopped, Officer Roskos approached the vehicle and made contact with the driver, who was identified as 23-year-old Sierra Archibeque. As he was speaking with the driver, Officer Roskos detected the odor of alcohol. He asked her if she knew what the speed limit was, and told Sierra that he was stopping her because she was driving 70 MPH in a 40 MPH zone. When he asked Sierra if she had been drinking, she denied having consumed any alcohol. Based on her suspicion of impairment, Sierra was offered an opportunity to perform field sobriety exercises. Officer Roskos started with the Horizontal Gaze Nystagmus (HGN) test. During the HGN test, Officer Roskos observed a lack of smooth pursuit, distinct and sustained nystagmus at maximum deviation, and the onset of nystagmus prior to 45 degrees. The second field sobriety exercise was the Walk and Turn test. During this exercise, Sierra displayed a lack of balance and failed to touch heel-to-toe on each step. The third field sobriety exercise was the One Leg Stand test, and Sierra did not raise her foot in the proper fashion while counting in an incorrect sequence. The fourth exercise involved counting backwards from 72 to 51, and Sierra failed to count in the correct backward sequence. The final exercise was the recitation of the alphabet from “I” to “Q,” but Sierra recited the alphabet from “I” to “Z” instead. Based on her excessive speeding, erratic driving, her incoherent statements, and her inability to adequately complete the field sobriety exercises, Officer Roskos placed Sierra under arrest for driving under the influence. Sierra’s vehicle was impounded and she was transported to the Rio Rancho Police Department for initial processing. At the Rio Rancho Police Department, Officer Roskos read Sierra the New Mexico Implied Breath Consent advisory form, and she agreed to submit breath samples. Officer Roskos administered the Intoxilyzer machine after Sierra completed the 20-minute observation period. Her Intoxilyzer results indicated a BAC of 0.13% and 0.12%, which were over the legal limit of 0.08% for drivers over the age of 21. After Sierra was processed at the Rio Rancho Police Department, he transported her to the Sandoval County Detention Center and booked her for DWI. Officer Roskos issued Sierra the following summonses: Driving while under the influence of intoxicating liquor or drugs, speeding, open container, and failure to yield to emergency vehicle -------------------------------------------------------------------- Please LIKE, SUBSCRIBE, and consider supporting this channel (email us for more information).
