On May 10, 2023, a Cocoa Beach, Florida officer stopped a car for expired registration. The driver had no license on her, gave a name and birth date that did not check out, and was told she would have walked away with a warning. Instead she gave a second name, and the lie turned a routine stop into a felony investigation. When the officer moved to fingerprint her, she demanded to call her mom first, and the encounter turned physical. Legal Analysis Includes: - Whren v. California, 384 U.S. 757 (1966): fingerprints are physical evidence, not testimony, so the Fifth Amendment does not stop them - Miranda v. Arizona, 384 U.S. 436 (1966): Miranda attaches to custodial interrogation, not booking identification - Florida Statute 843.02: resisting an officer without violence, and Florida Statute 784.07: battery on a law enforcement officer - Graham v. Connor, 490 U.S. 386 (1989): the standard for judging the force used Content Advisory: This video contains body camera footage of a physical struggle during an arrest, with screaming.
