The driver involved was identified as R. G. Restivo, a 34-year-old from Boca Raton, Florida. As an officer approached her, he noticed the strong smell of alcohol on her breath, along with her watery eyes and slurred speech. Restivo had already told another officer that she had been drinking earlier that day. The officers, suspecting Restivo was impaired, offered her a Standardized Field Sobriety Test (SFST). After the Horizontal Gaze Nystagmus (HGN) test, the officer noted several signs. Restivo showed Lack of Smooth Pursuit and had distinct, sustained nystagmus when her eyes were at maximum deviation. The officer also saw the onset of nystagmus before 45 degrees in both eyes. However, there was no vertical nystagmus observed. Throughout the test, Restivo kept moving her head and didn't follow the instructions correctly. The second test was the Walk and Turn (WAT) Test. During the instructions, Restivo stood in a heel-to-toe position as the officer showed her how to perform the test. When it was time to start, she took nine steps forward but struggled to keep her feet in the correct position. Throughout the test, Restivo repeatedly failed to follow the instructions given to her. The last test was the One Leg Stand (OLS). After it was shown to Restivo, she had no questions. When she started the test, she struggled to keep her foot six inches off the ground. Eventually, she had to lower her foot and lost her balance. The officer observed Restivo struggling to perform the required tests. At around 7:12 PM, she was informed that she was under arrest for Driving While Intoxicated (39:4-50). After being taken to Hoboken Police Headquarters, Restivo agreed to give breath samples. She was then moved to the Jersey City Police Department at 365 Summit Avenue to take the breath test. The results showed her blood alcohol concentration was 0.17%, more than twice the legal limit. At about 8:37 PM, Restivo was brought back to the Hoboken Police Headquarters. Lieutenant Gonzalez then briefed Officer Arroyo on the events that occurred at the scene. Witnesses reported that Restivo was speeding when she collided with a blue Chevy Malibu parked near a fire hydrant. This crash pushed the Malibu, causing it to hit Lauren Hardie Vallone, who was standing by the passenger side. Additionally, the impact sent Restivo's black Chevy Cruze airborne, flipping over and crashing into a properly parked gray Toyota Highlander across the street. An ambulance arrived to check on Hardie, who was then taken to Jersey City Medical Center for treatment. Officers Bates and Lupo went to the hospital to learn about her injuries. They found out that Hardie had a fractured upper femur in her right leg and that her hip would need to be reset due to the accident. At about 10:21 PM, Sergeant Roary Miller reached out to Sergeant Ragland from the Hudson County Prosecutors Office – Crash Investigations Unit. Sergeant Ragland advised Sergeant Miller to charge Restivo only with Assault by Auto (3rd Degree) based on the overall situation. They would consider upgrading the charge to Serious Bodily Injury (2nd Degree) later if needed. Officer Fitzgibbons took Restivo's fingerprints and gave her a Summons for Assault by Auto (3rd Degree) along with tickets for Driving While Intoxicated and Reckless Driving. After completing the processing, Restivo was released to a family member after signing the Potential Liability Form. 1:03 Mmmeeeeeeeeeeehhhhhhhh.
