Around 1:56 AM on May 4, 2025, Officers Jake Schuman and Katherine Calienni with the Rutherford Police Department first responded to a report of a motor vehicle accident at Station Square. They arrived on scene and noticed a grey 2021 Mazda CX-5 had collided with a grey 2013 Hyundai Elantra. The driver of the Hyundai, Ravinder Singh, told the officers that he was traveling west on East Erie Avenue exiting Station Square when he was struck by the driver of the Hyundai. Since he was complaining of lower back pain, first responders with the Rutherford Ambulance Corps responded to the scene and transported him to Hackensack University Medical Center. The officers then spoke with the driver of the Mazda, who was later identified as Misty Millette. She told the officers that she was heading back home after leaving a bar. As the officers were speaking with her, they detected the odor of alcohol and observed other indicators of impairment. Misty admitted to consuming alcohol earlier that evening, and there was an open White Claw can inside her vehicle. Based on their suspicion of impairment, Misty was asked to perform field sobriety exercises. The first exercise was the Horizontal Gaze Nystagmus test. During the HGN test, Officer Calienni observed 6/6 indicators of impairment. The second exercise was the Walk and Turn. During the Walk and Turn test, Misty failed to touch heel-to-toe on each step, took an incorrect number of steps, and failed to turn. The final exercise was the One Leg Stand test, but Misty told the officer that she was unable to perform this test. Based on the motor vehicle accident involving another Uber driver, the odor of alcohol, her admission to consuming alcohol earlier that evening, and her inability to satisfactorily complete the field sobriety exercises, Officer Schuman placed Misty under arrest for driving under the influence. Her vehicle was impounded for a mandatory 12-hour hold under John’s Law. Officer Schuman initially transported Misty to the neighboring East Rutherford Police Department for the administration of the breath test. At the East Rutherford Police Department, Misty was read the Standard Statement for Motor Vehicle Operators, but refused to submit breath samples. Following her refusal to submit breath samples, Misty was transported back to the Rutherford Police Department for further processing. When the officers were finished with processing her, Misty was released to Jessica Cruz pending her court appearance after she signed the Potential Liability Warning form on Misty’s behalf. Misty was issued the following traffic citations: -Operating under the influence (39:4-50) -Consent to take samples of breath (39:4-50.2) -Refusal to submit to chemical test (39:4-50.4A) -Careless driving (39:4-97) -Wrong way on one way street (39:4-85.1) -Traffic on marked lanes (39:4-88) -No liability insurance coverage on motor vehicle (39:6B-2) -Open container (39:4-51B) Since the other driver was injured as a result of the drunken crash, Misty was also criminally charged with assault by auto by operating a motor vehicle under the influence (2C:12-1C(2)). On October 7, 2025, Misty pleaded guilty to operating under the influence. As a result of her guilty plea, Misty had to spend 12 hours at an intoxicated driver resource center, use an ignition interlock device for 3 months, and pay a total of $1,123 in fines. This included a $733 fine for the assault by auto charge, for which she was also granted a conditional dismissal in 1 year. The other 8 traffic citations were dismissed as part of a plea agreement. ---------------------------------------------- Please LIKE, SUBSCRIBE, and consider supporting this channel (email us for more information). (P.L. 2024, c.16). Defendants are considered innocent until proven guilty. The New Jersey Supreme Court has previously affirmed in Salzano v. North Jersey Media Group, 993 A.2d 778 (2010) that “The fair-report privilege reflects the judgment that the need, in a self-governing society, for free-flowing information about matters of public interest outweighs concerns over the uncompensated injury to a person's reputation.” This video advances a compelling public interest. The summary of events was based on records that are “open to public view through open access to public records” as defined in the Salzano case. In Ramos v. Flowers, 429 N.J. Super. 13, the Appellate Division of the Superior Court has also affirmed the right to film law enforcement interactions.
