Around 11:20 PM on November 23, 2024, Officer Nicholas Jones with the Sarasota Police Department was conducting patrol in the area of 1558 1st Street. He observed a black Toyota Prius backed into a parking space in, and a female had fallen asleep in the driver’s seat while the driver’s side door was open. He made contact with the female, who was later identified as 20-year-old Marta Svirgun. Marta was awakened by Officer Jones after he shook her arm. As he was speaking with her, he detected the odor of alcohol and noticed that her speech was slurred. Marta told him that she was coming from work. She was initially offered an opportunity to exit the vehicle and call a ride home, but she repeatedly refused to cooperate. Eventually, 3 other officers arrived on scene to assist. Around this time, Marta was asked to perform field sobriety exercises. Officer Jones started with the Horizontal Gaze Nystagmus (HGN) test. He could not complete the test because Marta kept moving her head. The second exercise was the Walk and Turn test. Marta did not seem to understand the difference between her right and left foot, and repeatedly failed to follow directions. After multiple attempts, the tests were eventually terminated. Based on her being in physical control of the vehicle, her indicators of impairment, the odor of alcohol, and her inability to adequately perform the field sobriety exercises, Marta was placed under arrest for driving under the influence. Marta was transported by Officer Jones to the Sarasota County jail for further processing. At the jail, she eventually agreed to submit to a breath test after the Implied Consent Warning form was read to her. Her breath test results indicated BAC levels of 0.242% and 0.236%, which were approximately triple the legal limit of 0.08% for drivers over the age of 21. Marta was charged with DUI (316.193(1)(a)) and DUI with BAC Over .15 (316.193(4)), and eventually released pending her court appearance. ---------------------------------------------------- Please LIKE, SUBSCRIBE, and consider supporting this channel (email us for more information).
