The driver did not seem to know about the tire and ignored his attempts to signal her. As he followed, he watched the Passat travel about 350 feet in the wrong direction, using the eastbound lane. Shellabarger turned on his emergency lights, and the car stopped on NE Monroe Street. The driver was identified as 21-year-old Ellie Hansen. When Shellabarger approached Ellie, he smelled alcohol and saw that her eyes were red and watery. An open can of Modelo sat inside the car. He asked for her paperwork and explained the reason for the stop. When asked whether she had been drinking, Ellie said she had consumed wine earlier that day. Because Shellabarger was still in training, he called for another officer to handle the field sobriety tests. Officer Brock Westerman arrived a few minutes later and took over. Ellie agreed to perform the tests after Westerman saw signs that she might be impaired. Westerman started with the Horizontal Gaze Nystagmus test. Ellie's eyes failed to move smoothly, and he saw clear nystagmus when her eyes reached maximum deviation. He also saw it begin before 45 degrees. During the Walk and Turn test, Ellie had trouble walking heel-to-toe in a straight line. She took ten steps instead of the required nine. On the One Leg Stand, she could not raise her foot properly and put it down several times. She also failed to count aloud and moved her arms to keep her balance. After the tests, Westerman asked Ellie to take a voluntary breath test. The result showed a blood alcohol concentration of 0.212%, nearly three times the legal limit. Based on her test performance and the high reading, he arrested her for driving under the influence. Shellabarger parked her car in a nearby Starbucks lot, then drove Ellie to the Pullman Police Department for processing. At the station, Westerman handled the paperwork and testing because Shellabarger was still learning. He read Ellie her Miranda rights and the Implied Consent Warning. She agreed to give breath samples. During the 20-minute observation period, Ellie again said she had been drinking wine earlier. The Alcotest later showed a blood alcohol concentration of 0.227%, the lowest IR result. After the breath test, Shellabarger took Ellie to a cell. She waited briefly before officers brought her out for photographs and fingerprints. Ellie then received her belongings and was released with a court summons. Shellabarger charged her with driving under the influence under RCW 46.61.502 and instructed her to appear in court in Colfax. If you enjoyed this BodyCamBust video.
