Please like, comment, and SHARE! 🙏 🔍 Episode Overview: At approximately 11:51 p.m. on May 2, 2024, Patrolman John Mania of the Middletown Township Police Department was on patrol in the area of State Route 35 North and Chapel Hill Road when he observed a black 2021 model Mazda vehicle swerving between lanes several times. He activated his emergency lights in the area of Buckingham Circle, but the female driver did not stop the vehicle until she approached the area of State Route 35 North and Woodland Drive. After she finally stopped, Patrolman Mania made contact with the female driver, who was identified as Asma. Asma was asked for her papers, and Patrolman Mania asked her where she was from. When Patrolman Mania spoke to her, he smelled alcohol. Asma told him that she had been at Charlie’s in Lincroft that night for a work function before going to Gabriela’s in Red Bank. When he asked her if she had had anything to drink, she initially admitted to having a glass of wine at Gabriela’s. However, she later admitted to having two glasses of wine and possibly champagne. Asma handed Patrolman Mania a card stating that her brother was a police officer. After Patrolman Chambers arrived on the scene to assist, Patrolman Mania returned to his patrol car to verify her information. Suspecting that Asma was intoxicated, she was asked to exit the vehicle and perform field sobriety exercises. The first exercise was the Horizontal Gaze Nystagmus (HGN) test, and Sergeant Mazza observed an absence of smooth pursuit, a pronounced and persistent nystagmus at maximum deviation, and the onset of nystagmus before 45 degrees. No nystagmus of the vertical gaze was observed. The second exercise was the walk-and-turn test. During the walk-and-turn test, Asma did not touch her heel on each step, took an incorrect number of steps, and used her arms for balance. The final exercise was the one-leg stand test, in which Asma did not lift her foot correctly and swayed while balancing. Due to her erratic driving behavior, the odor of alcohol on her person and her inability to properly complete field sobriety exercises, Patrolman Mania arrested Asma for driving under the influence of alcohol. Her vehicle was impounded to serve a 12-hour John’s Law suspension. She was transported by Patrolman Mania to Middletown Township Police Headquarters for further processing. At police headquarters, Asma was read the standard declaration for motor vehicle drivers and initially agreed to provide breath samples for testing. Sgt. Michael Heaton attempted to administer the Alcotest device to her, but despite four separate attempts, she failed to provide sufficient samples and was eventually charged with refusal. At the conclusion of the trial, Asma was eventually released to a friend who signed the warning of potential liability form on her behalf. She was issued the following citations: Driving Under the Influence of Alcohol, Consent to Take Breath Samples, Reckless Driving, Failure to Wear a Seat-belt, and Driving in Marked Lanes.
