On a May afternoon in Florida, with the temperature above ninety two degrees, officers were called to a shopping plaza parking lot for a report of a dog shut inside a parked car. What follows is the full body camera record of what they found, how they got the door open, and what happened when the owner came out of the store. It is also a case about a decision most people never see. For an offense at this level the officer had the option to write a criminal citation and let the courts handle it. He explains on camera, in his own words, why he could not do that here. The puppy was given water at the scene, placed in an air conditioned patrol vehicle, and released to animal control. WHAT THE LAW ACTUALLY SAYS Cruelty to animals in Florida is section 828.12 subsection 1, a first degree misdemeanor carrying up to a year and a fine of up to five thousand dollars. The felony version, subsection 2, requires the animal to suffer repeated or extreme harm. If you find an animal locked in a hot car in Florida, section 768.139 can shield you from liability for the damage if you break in, but only if all four conditions are met. You must reasonably believe the animal is in danger with no other way out, you must call for help before entering or immediately after, you must use no more force than necessary, and you must stay with the animal until responders arrive. That protection is not the same in every state. A notice to appear, under Rule 3.125 of the Florida Rules of Criminal Procedure, is a written order issued instead of a physical arrest. It is available for misdemeanors and ordinance violations only.
