On 04/24/2024, at approximately 0053 hours, officers were dispatched to VI/WALGREENS, 11701 Detroit Ave., in response to a call that a black male, later identified as OF/DEMARKOS SIMMONS, took wine (later determined to be champagne), cigarettes, sleeping pills (later determined to be Nyquil medication) and left eastbound on Detroit Ave. Dispatch provided a further description of SIMMONS: black male wearing a gray jacket and dark pants. Dispatch advised SIMMONS was observed on the city cameras going into the parking lot/alley of My Friends, 11616 Detroit Ave. Ptl. Kilnapp checked the area and observed SIMMONS walking near My Friends holding the champagne bottle. Ptl. Kilnapp ordered SIMMONS to stop multiple times, but SIMMONS walked away heading eastbound on Detroit Ave. SIMMONS told Ptl. Kilnapp that he was going to have to shoot SIMMONS. Due to SIMMONS behavior and verbal statements, Ptl. Kilnapp requested other officers to respond Code 3 and pulled out his taser and pointed it at SIMMONS. SIMMONS stopped, threw the champagne bottle in a bush, put his hands up, and turned around. Ptl. Kilnapp arrested SIMMONS for Obstructing Official Business. Inv. Allen arrived on scene to assist. See Ptl. Kilnapp`s supplement for further. Ptl. Kilnapp placed SIMMONS in the rear of unit 215 and transported him to the LPD jail, where he was booked in by Ptl. Hokin. Inv. Allen followed Ptl. Kilnapp to the LPD jail to assist in the booking process. I went to WALGREENS with the above confiscated items, and IO/TRAE ALEXANDER RUSCIN, the manager, confirmed the items to be stolen from the store. RUSCIN stated his coworker was watching SIMMONS in the aisle and observed SIMMONS take the Nyquil, open the box, and walk toward the wine. When RUSCIN`s coworker told SIMMONS to leave the store, RUSCIN stated SIMMONS was aggressive toward his coworker and yelled that he was tired and was not putting the items back. RUSCIN stated he was in the stock room during this time and heard on the store PA system something about wine. When RUSCIN went back into the store from the stock room he stated he saw his coworker on the phone speaking with dispatch regarding the incident. In the process of determining the source of the 8 packaged Nyquil liquicaps, RUSCIN`s coworker found an opened 24 pack of Nyquil medication on top of a shelf in the aisle near the location the medication was stocked. The 750mL bottle of Korbel California Champagne was $17.99. The pack of Marlboro Menthol 100`s cigarettes was $17.99. The pack of Hyland`s Naturals Pain Relief and Irritant Drawing Salve was $9.79. The 24 pack of Vicks Nyquil Severe Cold and Flu Nighttime Relief Liquicaps was $17.99. The total value of the items stolen was $52.61. RUSCIN stated the pack of Marlboro cigarettes and Hyland`s Natural medication were able to be restocked, however, the 24 pack of Vicks Nyquil medication was unable to be restocked due to SIMMONS opening the box to take the 8 packaged liquicaps. RUSCIN stated he was unsure if the bottle of Korbel California Champagne was able to be restocked and that he would contact his manager to determine if it could be restocked. Upon viewing the store`s surveillance camera footage, SIMMONS can be seen entering the store at approximately 0048 hours. SIMMONS can then be seen in the aisle near the Nyquil medication at approximately 0052 hours and putting an item, later identified as the opened 24 pack of Nyquil medication, on top of the shelf. At approximately 0053 hours, SIMMONS can be seen in the aisle near the champagne taking the bottle of Korbel California Champagne off the shelf and walking toward the front of the store. At approximately 0053 hours, SIMMONS can be seen walking up to the cash register and taking the pack of Marlboro Menthol 100`s cigarettes from behind the register before leaving the store at approximately 0054 hours without paying for the items. I took videos of the footage along with a still photograph of SIMMONS and uploaded them to Evidence.com. The recovered items were released to RUSCIN. RUSCIN desires prosecution and requested SIMMONS to be advised not to return. At the booking window, Ptl. Kilnapp advised SIMMONS of the additional charge of Misdemeanor Theft. Ptl. Kilnapp also advised him not to return to WALGREENS or he would be arrested for Criminal Trespass. Dispatch added SIMMONS to the premise file. At the booking window, Ptl. Kilnapp advised SIMMONS of the additional charge of Misdemeanor Theft. Ptl. Kilnapp also advised him not to return to WALGREENS or he would be arrested for Criminal Trespass.
