A routine traffic stop quickly escalates as officers confront a driver exhibiting clear signs of impairment, leading to a critical roadside decision point. Patrolman Braswell initiated the stop around 6:27 PM on April 23, 2022, after observing a 2013 BMW driving erratically on Route 36, failing to maintain its lane. The driver, a middle-aged woman, displayed slurred speech and seemed unaware of the reason for the stop, stating she was driving her ex's car to see her son nearby. This initial interaction, coupled with the observation of damage on the vehicle's front passenger side bumper, prompted officers to call for a supervisor and prepare for field sobriety tests. Officers then instructed the driver to exit her dark blue sedan to begin the assessment, a pivotal moment captured on bodycam. During the subsequent tests, including the Horizontal Gaze Nystagmus, Walk and Turn, and One Leg Stand, she struggled significantly, failing to follow instructions and maintain balance, though she completed the alphabet test without error. Based on her erratic driving patterns, traffic infractions, and inability to adequately perform the field sobriety exercises, she was placed under arrest for driving under the influence. She was later transported to police headquarters where she invoked her Miranda rights and refused to submit to a chemical breath test. Ultimately, she was released with multiple summonses, including charges for driving while intoxicated, refusal to submit to chemical breath testing, failure to maintain lane, uninsured out of state vehicle, and reckless driving, after someone signed a potential liability warning on her behalf. --- Transparency through the lens of the law.
