Around 10:32 PM on September 6, 2025, Officers Vincent Fischer and Kevin Pisano with the Denville Township Police Department were stopped at a red light at Route 46 East and Route 53 South. They performed a random plate check on a white 2021 Acura, and learned that the vehicle did not have a valid registration. They initiated a traffic stop, and the driver pulled over on Route 53 just south of the Route 80 overpass. The driver of the Acura was identified as Toshiba Foster, a Democrat who serves as a Councilwoman in Morristown. As they started speaking with Toshiba, the officers detected the odor of alcohol and observed other indicators of impairment. Toshiba told the officers that she was headed home after coming from a friend’s house. Based on their suspicion of impairment, Toshiba was asked to exit the vehicle and perform field sobriety exercises. The first exercise was the Horizontal Gaze Nystagmus (HGN) test. The second exercise was the Walk and Turn test. During the Walk and Turn test, Toshiba did not touch heel-to-toe on each step, took an incorrect number of steps, and turned improperly. The third exercise was the One Leg Stand test. During the One Leg Stand test, Toshiba failed to raise her foot in the proper fashion and did not keep her arms at her sides. Based on the odor of alcohol, her indicators of impairment, and her inability to satisfactorily complete the field sobriety exercises, Toshiba was placed under arrest for driving under the influence. A search of her vehicle incident to arrest yielded multiple sealed bottles of Prosecco wine. Her vehicle was impounded for a 12-hour hold according to John’s Law. Toshiba was transported to the Denville Township Police Department for further processing. At the station, the Standard Statement for Motor Vehicle Operators was read to her, and she agreed to submit breath samples. Her Alcotest results indicated a BAC level of 0.20%, which was more than double the legal limit of 0.08%. After the officers finished processing her, Toshiba was eventually released to her daughter pending her court appearance. Officer Fischer issued Toshiba the following citations: -Operating under the influence (39:4-50) -Reckless driving (39:4-96) -Careless driving (39:4-97) -Driving an unregistered motor vehicle (39:3-4) Court records indicate that Toshiba has previously been accused of assault on at least 3 different occasions. She faced allegations of harassment (2C:33-4A) and simple assault (2C:12-1A(1)) on May 18, 1993, but those charges were later dismissed after the complainant failed to appear. Toshiba once again faced allegations of harassment (2C:33-4A) and simple assault (2C:12-1A(1)) on January 14, 1994. On April 4, 1994, Toshiba was found guilty despite pleading not guilty. As a result of being found guilty, Toshiba was fined a total of $68 and sentenced to 180 days in jail. A few years later, Toshiba faced an allegation of simple assault (2C:12-1A) from November 21, 2001. She was later found not guilty of that charge on January 18, 2002. In addition to her prior allegations of assault, her most recent traffic citation was for using a hand-held wireless telephone while driving (39:4-97.3) on October 31, 2017 in Morristown. Court records indicate that case was transferred from the Morristown Municipal Court to the Madison Joint Municipal Court and then transferred again to the Morris Plains Municipal Court. She ultimately pleaded guilty to that citation and paid a total of $233 in fines. Toshiba has also received numerous parking tickets in Morristown over the past 2 decades. ---------------------------------------------- Please LIKE, SUBSCRIBE, and consider supporting this channel (email us for more information). (P.L. 2024, c.16). Defendants are considered innocent until proven guilty. The New Jersey Supreme Court has previously affirmed in Salzano v. North Jersey Media Group, 993 A.2d 778 (2010) that “The fair-report privilege reflects the judgment that the need, in a self-governing society, for free-flowing information about matters of public interest outweighs concerns over the uncompensated injury to a person's reputation.” This video advances a compelling public interest. The summary of events was based on records that are “open to public view through open access to public records” as defined in the Salzano case. In Ramos v. Flowers, 429 N.J. Super. 13, the Appellate Division of the Superior Court has also affirmed the right to film law enforcement interactions.
