Around 8:22 PM on February 13, 2023, Officer Tyler Clark with the East Windsor Township Police Department responded to a report of a hit-and-run crash involving a 2019 Subaru striking a 2012 Honda. Officer Clark made contact with the driver whose vehicle was struck at the Shell gas station, and he was informed that a woman driving a Subaru struck his vehicle while he was stopped at a red light on Lake Drive near the Route 33 intersection. The driver fled the scene after the crash, and he called the driver a “drunk lunatic” because another witness told him that she may have been driving while impaired. The caller was able to provide police with a license plate and a vehicle description, and police learned that the vehicle was registered to 34-year-old Evelisse Concepcion. After he gathered all the necessary information, Officer Clark proceeded to Evelisse’s residence nearby. As he looked around in the parking lot of her apartment complex, he found a 2019 Subaru matching the witness description, and noticed that there was fresh front-end damage on the bumper. Officer Clark subsequently made contact with Evelisse in her residence, and asked her whether she had been involved in a car accident. Evelisse was initially in denial, but when confronted with the evidence, she admitted that she had made a trip to that Shell gas station to purchase cigarettes. Officer Clark escorted Evelisse and her husband to the parking lot and showed them the fresh damage on her vehicle, which was linked to the hit-and-run accident. Based upon his suspicion of impairment, Officer Clark decided to administer field sobriety exercises. Officer Adelung arrived on scene to assist and started the field sobriety exercises with the Horizontal Gaze Nystagmus (HGN) test. During the HGN test, Officer Adelung observed a lack of smooth pursuit and the onset of nystagmus prior to 45 degrees. The second exercise was the Walk and Turn test, which was administered by Officer Clark. During the Walk and Turn test, Evelisse displayed a lack of balance while failing to walk heel-to-toe in a straight line. The third exercise was the One Leg Stand test. For the One Leg Stand test, Evelisse did not raise her foot in the proper fashion and swayed her arms while displaying a lack of balance. Based on the witness descriptions, her inconsistent statements, the odor of alcohol on her person, and her inability to adequately complete the field sobriety exercises, Officer Clark placed Evelisse under arrest for driving under the influence. Her vehicle was turned over to her husband, while Officer Clark transported Evelisse to the East Windsor Township Police Department for initial processing. At police HQ, Evelisse was read the Standard Statement for Motor Vehicle Operators and agreed to submit breath samples. Officer Nicholas Hoffmann administered the Alcotest machine and the results indicated a BAC of 0.09%, which is more than the legal limit of 0.08%. After Evelisse was processed, she was released to her husband pending her court appearance after he signed the Potential Liability Warning form on her behalf. Officer Clark issued her the following summonses: Operating under the influence, leaving the scene of an accident, failure to report an accident, reckless driving, and careless driving --------------------------------------------------------------- Please LIKE, SUBSCRIBE, and consider supporting this channel (email us for more information). All videos and case documents were obtained pursuant to the New Jersey Open Public Records Act, N.J.S.A. 47:1A-1 et seq. (P.L. 2001, c. 404). Defendants are considered innocent until proven guilty. The New Jersey Supreme Court has previously affirmed in Salzano v. North Jersey Media Group, 993 A.2d 778 (2010) that “The fair-report privilege reflects the judgment that the need, in a self-governing society, for free-flowing information about matters of public interest outweighs concerns over the uncompensated injury to a person's reputation.” This video advances a compelling public interest. The summary of events was based on records that are “open to public view through open access to public records” as defined in the Salzano case. In Ramos v. Flowers, 429 N.J. Super. 13, the Appellate Division of the Superior Court has also affirmed the right to film law enforcement interactions.
