Eventually, the vehicle stopped near the intersection with West Elmer Road. Upon approaching the vehicle, Officer Perez noticed that the occupant in the vehicle was the SAME person who had been arrested for ANOTHER DWI less than 2 weeks earlier on December 22, 2022. Now it was apparent that the unlicensed driver, identified as Yaquelin Lopez-Lopez, was going to be ringing in the New Year with a NEW DWI! Officer Lopez called for backup units to administer field sobriety tests. Officer Rosa arrived shortly thereafter and started with the Horizontal Gaze Nystagmus (HGN) test. Officer Lopez translated for Officer Rosa, since Lopez-Lopez was not fluent in English. The HGN test was followed by the Walk and Turn test involving heel-to-toe steps in both directions. After starting the Walk and Turn test, Lopez-Lopez was unable to complete them satisfactorily. Officer Rosa proceeded to ask Lopez-Lopez directly if she was drunk, and Officer Lopez asked her if she did not want to perform the tests. Lopez-Lopez nodded and implicitly admitted to being drunk. Based on her erratic driving and her failure to adequately perform the field sobriety exercises, Lopez-Lopez was placed under arrest for driving under the influence. She was subsequently brought to the station, where she refused to take the breathalyzer test.
