Please like, comment, and SHARE! 🙏 🔍 Episode Overview: At approximately 11:12 PM on February 26, 2022, Patrolman Marc Eustace of the Allenhurst Police Department observed a 2020 Toyota traveling without activated headlights in the shoulder on Norwood Avenue heading north near the intersection with Cedar Avenue. Upon noticing this violation, he promptly activated his emergency lights and proceeded to initiate a traffic stop as the vehicle continued its northward course. The driver complied and halted the vehicle on Norwood Avenue, shortly past Neptune Avenue in the neighboring borough of Deal. Patrolman Eustace then approached the driver, identified as Michelle, to address the situation. As he approached the vehicle and rapped on her windows, Patrolman Eustace observed that she was engaged in a conversation on her Bluetooth device, discussing the possibility of her getting a DWI. Michelle was requested to present her documents, but seemed to struggle with them. She informed the officer that she was coming from Long Branch, despite the fact that Long Branch was located much further north, and she was actually traveling north on Norwood Avenue. Patrolman Eustace inferred that she might have been traveling north from Asbury Park, as it was a short distance south. Michelle denied consuming any alcohol earlier that evening. However, due to Patrolman Eustace's suspicion of impairment, he asked Michelle to step out of the vehicle and perform field sobriety exercises. During the initial assessment, Patrolman Eustace conducted the Horizontal Gaze Nystagmus (HGN) test. He observed irregularities such as the absence of smooth pursuit, evident and sustained nystagmus at maximum deviation, and the initiation of nystagmus before reaching 45 degrees. Next, the Walk and Turn test was administered, during which Michelle demonstrated failure to maintain heel-to-toe contact on each step, took an incorrect number of paces before being reminded to turn, and neglected to keep her arms alongside her body. The final assessment, the One Leg Stand test, revealed Michelle's inability to elevate her foot in the correct manner or recite the numbers in proper sequence. Upon observing Michelle's erratic driving behavior and her inability to successfully complete the field sobriety exercises, Patrolman Eustace decided to place her under arrest for driving under the influence. Following the arrest, her vehicle was impounded in accordance with the mandatory 12-hour hold stipulated by the Law. Michelle was then escorted by Patrolman Eustace to the Allenhurst Police Department for further processing. At the police headquarters, Michelle was instructed with the Standard Statement for Motor Vehicle Operators and initially consented to provide breath samples for testing. However, she became physically ill 15 minutes into the 20-minute observation period. Following the restart of the observation period, she appeared to have fallen into a profound slumber and subsequently received evaluation from First Aid personnel. After being cleared by First Aid, a third observation period commenced, but Michelle experienced another bout of vomiting before the Alcotest could be administered. Due to her impaired state, First Aid was summoned once more, and Michelle was subsequently transported to Monmouth Medical Center for a blood draw. Subsequently, Michelle was released pending her court appearance scheduled for March 15, 2022, facing summonses for operating under the influence, reckless driving, traffic on marked lanes, and failure to use lighted lamps. According to court records dated January 5, 2023, Michelle was convicted of driving under the influence. Consequently, Michelle was mandated to complete a 12-hour program at an intoxicated driver resource center, use an ignition interlock device for a period of 3 months, and settle a total of $740 in fines. The remaining 3 citations were dismissed.
