It really helps us do original reporting like this. 🔍 Episode Overview: On February 26, 2022, around 4:41 PM, Patrolman Matthew Niebling of the Howell Township Police Department was called to Driftway Road. A bicyclist had fallen into the street. Patrolmen Matthew Cuzzo and Daniel Bozza arrived and found a 35-year-old woman named Nicole. Next to her was a black and green electric bicycle, and she was wearing a helmet. It was clear she had fallen after hitting a JCP&L pole, but the pole showed no signs of damage. Officers were getting ready to help Nicole when they noticed a smell of alcohol. They found a bottle of vodka in her jacket pocket. Soon after, first responders arrived and placed her in an ambulance. Patrolman Kevin Kubiel asked her if she would allow a blood test, but she said no. He then reached out to the Monmouth County Prosecutor’s Office to ask for a warrant. Judge Scott Basin approved the warrant for her blood draw. A nearby resident captured the accident on their security camera and shared the footage with the police. The video clearly showed Nicole driving east on Driftway Road when she crossed into oncoming traffic and hit a JCP&L utility pole. While emergency responders placed Nicole in an ambulance, her sister arrived at the scene and provided officers with extra details. After filling out the Potential Liability Warning form for Nicole, the officers returned the electric bicycle to her sister right there. After Nicole returned home from the hospital, a Howell Township Police officer arrived at her house to give her three summonses. She received these charges: operating under the influence, reckless driving, failure to obey a traffic signal, and operating a motorized bicycle while under the influence. Court records show that on June 3, 2022, in Howell Township Municipal Court, all three summonses were dismissed, even though she had an open container of alcohol with her.
