#news #police #arrest #cops Report: On 03/24/2023, At 21:45 Officer was conducting traffic enforcement when the officer observed a white sedan traveling at a slow rate of speed in the passing lane. He utilized his LIDAR device to check the vehicle's speed at 35MPH in a 55MPH zone. As the vehicle was impeding the flow of traffic, Officer requested another officer who was with me to go and follow the vehicle to observe its driving pattern. The officer then observed the vehicle failing to maintain its lane, driving in-between both lanes. The officer conducted a traffic stop on the vehicle by activating his emergency lights and siren, and the vehicle failed to yield. Officer caught up to the traffic stop and drove alongside the sedan and observed a female driver who appeared disoriented. The vehicle then immediately made a right turn into the curb, bouncing over the curb, driving over the sidewalk and into the Petro Express Gas Station's parking lot. Officer pulled in front of the vehicle and the driver stopped. After the extremely reckless action of driving over the sidewalk in the manner she did, officer ordered the driver to shut off the vehicle and put her hands up. The following physiological indicators of impairment: ● Disoriented ● Confused ● Droopy eyelids ● Constricted pupils ● Slow, thick, slurred speech ● Slowed responses ● On the nod ● Uncoordinated ● Strong odor of an alcoholic beverage emitting from her mouth as she spoke ● Unsteady walk ● Difficulty balancing and even standing ● Drowsiness ● Difficulty concentrating ● Depressed reflexes ● Slow deliberate movements ● Drunk-like behavior ● Slow, sluggish reactions ● Impaired judgement ● Relaxed Inhibitions Due to the extreme amount of indicators of impairment Deal displayed, I asked her to participate in field sobriety exercises and she agreed to do so. Officer asked suspect how much alcohol she had consumed and she stated "too much." Showed in GCIC as a Habitual Violator and a driver's history report showed nine prior DUI arrests. The assisting officer asked Deal for permission to search the vehicle which was granted. The search resulted in finding 11 open containers of alcohol that were nearly entirely empty, and several other un-opened containers. The alcoholic beverages were "shooter bottles" of Vodka. Horizontal Gaze Nystagmus: ● Equal tracking and pupil size present in both eyes ● Lack of smooth pursuit present in both eyes ● Distinct and sustained nystagmus at maximum deviation present in both eyes Onset of nystagmus prior to 45 degrees present in left eye. I was unable to complete the exercise due to Deal's difficulty concentrating and level of intoxication and the fact that she continued to move her head to track the stylus. The onset of nystagmus was immediate in the left eye, indicative of a blood alcahal content of 0.15 or greater. Walk and Turn: ● Failed to maintain the instructional position ● Began before instructed ● Nearly every single step off line ● Nearly every single step not heel-to-toe ● Stopped while walking ● Incorrect number of steps (27 forward) ● Did not turn, did not return with nine steps back Officer placed suspect under arrest for driving under the influence amongst other charges and read her the State of Georgia's Implied Consent Notice requesting a blood draw and she refused. Suspect was booked in on the following charges: DUI-Multiple Substances-Less Safe Reckless Driving Failure to Maintain Lane Impeding the Flow of Traffic Possession of an Open Container of Alcohol in Passenger Compartment Suspects driver's license in GCIC showed that because of the Habitual Violator revocation, she must have an Interlock breathalyzer device in her vehicle; however, she was driving her father's vehicle which did not have this device installed. The vehicle had severe front-end damage that appeared to be fresh and it is unknown what she collided with.
