Around 2:31 AM on November 15, 2024, Officer Matthew Bonnano with the Hoboken Police Department observed the driver of white Honda fail to stop at a stop sign on Sinatra Drive. He followed the vehicle as the driver headed northbound and he initiated a traffic stop on Sinatra Drive in the vicinity of 6th Street. Officer Bonnano made contact with the driver, who was identified as Daniela. Officer Bonnano recognized the driver as someone who had been transported to Hoboken University Medical Center (HUMC) earlier that evening due to her state of intoxication. He asked Daniela for her documents, but she was initially unable to locate all of the necessary documentation. He was aware that she had consumed alcohol earlier that evening, so he called for another officer who was certified in field sobriety exercises to come on scene. Lieutenant Edward Sellick arrived on scene to assist, and Officer Domenick Allegretta came to administer the field sobriety exercises. Officer Allegretta led Daniela to a parking lot nearby, and he started with the Horizontal Gaze Nystagmus (HGN) test. The second exercise was the Walk and Turn test. During the Walk and Turn test, Daniela failed to touch heel-to-toe on each step while taking an incorrect number of steps. The final exercise was the One Leg Stand test, and Daniela failed to raise her foot in the proper fashion and put her foot down before the test was complete. Based on his prior interaction with Daniela earlier that evening and her inability to satisfactorily complete the field sobriety exercises, Officer Bonnano placed Daniela under arrest for driving under the influence. After she was placed under arrest, her vehicle was impounded for a 12-hour hold according to John’s Law. Officer Bonnano transported Daniela to the Hoboken Police Department for further processing. Officer Bonnano issued Daniela the following citations: Operating under the influence, reckless driving, and disregarding a stop sign ---------------------------------------------- Please LIKE, SUBSCRIBE, and consider supporting this channel (email us for more information). (P.L. 2024, c.16). Defendants are considered innocent until proven guilty. The New Jersey Supreme Court has previously affirmed in Salzano v. North Jersey Media Group, 993 A.2d 778 (2010) that “The fair-report privilege reflects the judgment that the need, in a self-governing society, for free-flowing information about matters of public interest outweighs concerns over the uncompensated injury to a person's reputation.” This video advances a compelling public interest. The summary of events was based on records that are “open to public view through open access to public records” as defined in the Salzano case. In Ramos v. Flowers, 429 N.J. Super. 13, the Appellate Division of the Superior Court has also affirmed the right to film law enforcement interactions.
