On December 4, 2024, officers responded to a report of a woman found intoxicated on private property. What began as a welfare check escalated into a multi-officer struggle involving OC spray, a hobble restraint, and an EMS response — and ended with the subject expressing explicit suicidal ideation in custody. In this analysis, we examine: ✅ Was the initial contact and trespass enforcement lawful? ✅ Was the use of OC spray legally justified? ✅ Did officers fulfill their duty-of-care obligations regarding the subject's mental health crisis? ✅ What does the law require when someone in custody expresses suicidal ideation? The subject was later charged with battery on a law enforcement officer and resisting arrest with violence. She received 48 months of probation, 50 hours of community service, and an 8-hour anger management program. ⚠️ Content Warning: This video contains footage of a use-of-force incident including pepper spray deployment, and includes statements about self-harm.
