#news #police #arrest Offenses: DUI - Drugs - Less Safe Signals Required on Turning/Changing Lanes/Stopping Failure to Maintain Lane/Improper Driving on Road Report: On April 5, 2022, Officer was patrolling in the area of West Broad Street and Milledge Avenue when Off. Castels observed a green Subaru turn left onto Milledge Avenue from West Broad Street. Off. Castels observed the vehicle fail to maintain its lane by both driver side tires crossing over the solid yellow line and return into its lane. We continued to follow the vehicle where I observed both drivers side tires cross over the solid yellow line and return into its lane again near the intersection of Milledge Avenue and Baxter Street. The Subaru then entered into the left turn lane to turn east on to Baxter Street. I then observed the vehicle pull back into the south bound lane of Millage Avenue and Springdale Street intersection. I activated the lights and initiated a traffic stop on the green Subaru. Walking up to the vehicle off. Castels and I made contact with the occupants of the vehicle who is later identified as LAUREN SZYMANSKI (driver seat) and Andrew Baird (front passenger seat) Officer Castels noticed Lauren had a heavy slurred speech. Officer Castels asked driver to step to the rear of the vehicle. Off. Castels and I noticed the driver was very unsteady on her feet and was unable to concentrate on the questions that were asked of her about where she was coming from and how much she had to drink that night. The driver consented to Standardized Field Sobriety Field Sobriety Tests. When I looked at the driver's eyes for Horizontal Gaze Nystagmus (HGN) in the medical evaluation I noticed her pupils were very large and not contracting to the light of my flashlight. On the HGN Test, I observed 6 clues. While checking the drivers eyes for lack of smooth pursuit, s unable to follow the tip of my pin with just her eyes after giving her instructions to do so 2 different times during the test. I also observed the clues of distinct and sustained nystagmus at maximum deviation and onset of nystagmus prior to 45 degrees. On the walk and turn I observed 8 clues. I observed the following 2 clues during the instructional stage; started too soon and failed to maintain balance. In the walking stage, Lauren missed heel to toe, stepped off lane, used arms to balance stops while walking, took too many steps and conducted the turn improperly. I demonstrated and explained the instructions for the one leg stand but Lauren could not follow instructions and ended up declining the test. Based upon the driving behavior of the driver, My observations of her, and her performance on standardized field sobriety test, I placed the driver under arrest for DUI - drugs less sage. I read Lauren implied consent law for a state administered chemical test of her blood. I asked the driver three times if she would consent to a state administered chemical test of her blood. She did not answer any time. I counted her inability to answer the question as a refusal. Baird who was in the passenger seat stated he and the driver went out to Boars Head in Athens and did drink alcoholic beverages. Upon searching the car, I located an empty mini bottle of vodka in rear driver side floor board. Baird was release from the scene.
