On January 28, 2023 at approximately 12:17 AM, Deputy Christopher Olin of the Whitman County Sheriff’s Office noticed a 2004 Acura driving weaving within its lane and swerving towards the curb on NE Merman Drive. As he followed the vehicle, he noticed the driver misjudge the distance to the stop line and roll through a stop sign. He proceeded to initiate a traffic stop, and the driver pulled into the Cougar Corner Mart store. The driver, 20-year-old Ciarra Mari Caday, seemed incoherent and the Deputy could smell the odor of intoxicants in her vehicle. He proceeded to ask Ciarra if she had consumed alcohol, and she initially admitted to only drinking 1 beer about 1 hour prior. Upon further questioning, Ciarra would later admit to consuming 2 beers and possibly a few shots. Based on her admission to consuming alcohol, Deputy Olin afforded her an opportunity to perform voluntary field sobriety tests. Given the cold weather outside, they went into the Cougar Corner Mart to perform the tests. The first exercise involved the Horizontal Gaze Nystagmus (HGN), where Deputy Olin observed the lack of smooth pursuit in both eyes and distinct and sustained nystagmus at maximum deviation in the left eye. The second exercise was the Walk and Turn test, and Ciarra was unable to walk a straight line and turned contrary to how she was instructed to do so. The final exercise was the One Leg Stand test. During the One Leg Stand test, Ciarra was unable to maintain her balance while she counted the numbers “11” and “15” twice. Following the voluntary field sobriety tests, Ciarra was asked to voluntarily take a PBT test, and the result was 0.078%. Based on her admission to consuming alcohol, her inability to perform the field sobriety exercises, and the results of her PBT test, Deputy Olin placed Ciarra under arrest for driving under the influence underage. Ciarra was subsequently transported directly to the Whitman County Jail for further processing, where she agreed to take a breathalyzer test. Deputy Olin read the Implied Consent Warnings to Ciarra, and she waived her Miranda rights by agreeing to answer questions. During questioning, Ciarra admitted to consuming at least 2 beers and possibly a few shots as well. She also admitted to having smoked marijuana earlier that afternoon. After the 20-minute observation period was complete, Ciarra submitted breath samples. Her Alcotest results indicated a BAC of 0.048%, which was under 0.08% but still over the legal limit of 0.02% for motorists under the age of 21. She was cited under RCW 46.61.503 for “Driver under twenty-one consuming alcohol” and released with a mandatory court date after posting bail at $500. On March 31, 2023, Ciarra pleaded guilty under 66.44.270(2)(a) for consuming liquor under the age of 21. She was sentenced to 12 months of supervised probation and she was required to complete 12 hours of community service. She was fined $43 under a Criminal Conviction Fee, $300 for the Probation/Monitoring Fee, and a $250 fine ($500 actual fine, $250 suspended). ----------------------------------------------------------------------------------------- Please LIKE, SUBSCRIBE, and consider supporting this channel (email us for more information).
