Officer Pittelko was the first to reach the location, where he found a 2022 Subaru WRX that had veered off the road and slid down a slope. Soon after, he saw a young woman getting out of the Subaru; she was later identified as 19-year-old Jessica S. Officer Pittelko told Jessica to stay by the car while he worked to find a safe way around the live electrical wires and reach her. Patrolman Pittelko checked to make sure no one else was in the car before leading Jessica out of the woods for a medical check. When the first responders arrived, they attended to Jessica, but she chose not to go to the hospital. Given how serious the accident was, Patrolmen Yevchak and Hahn decided to close the road for safety. After the road was closed, Patrolman Hahn walked over to Jessica and asked her to share what had happened. Jessica explained that she had lost control of her car, which led her to hit a utility pole before sliding down a hill. When Patrolman Hahn inquired about where she was coming from, Jessica mentioned she was on her way home after visiting a friend's house. Initially, she denied drinking any alcohol, but later she admitted to having some drinks and also not wearing her seat belt. Due to the officer's concerns about her impairment, Jessica was given a chance to take field sobriety tests. Patrolman Pittelko began the assessment with the Horizontal Gaze Nystagmus (HGN) test, where he noticed all six signs that suggested Jessica might be impaired. Following this, Patrolman Hahn conducted the Walk and Turn and One Leg Stand tests. During these exercises, Jessica showed no signs of impairment. The last test was the Modified Romberg Balance test, which Patrolman Yevchak carried out. While she counted a bit slowly, he observed that she remained steady and did not sway or struggle with her balance. After the car accident, Patrolman Hahn arrested Jessica for driving under the influence. She admitted to drinking alcohol and was under 21, which led to the arrest. Her car was taken and held for 12 hours, as required by John's Law. Jessica was then taken to the West Milford Police Department for further processing. At police headquarters, Patrolman Hahn explained the Standard Statement for Motor Vehicle Operators to Jessica. She agreed to provide breath samples for testing. Patrolman David Borowski then used the Alcotest machine to check her alcohol level. The results showed her blood alcohol concentration (BAC) was 0.05%. Although this was below the legal driving limit of 0.08% for those over 21, it exceeded the 0.02% limit set for drivers under 21.
