A routine traffic stop quickly intensifies when an officer observes clear signs of impairment in a driver. At approximately 6:27 PM on April 23, 2022, a patrolman initiated a stop on a 2013 BMW for erratic driving, including failure to maintain lane. The driver, a 37-year-old woman with slurred speech, initially claimed she was picking up her son and did not understand the reason for the stop. Due to her apparent intoxication, a supervisor was called to the scene, where officers also noted damage to the vehicle's front bumper. The driver subsequently failed multiple field sobriety tests, exhibiting a lack of smooth pursuit during the Horizontal Gaze Nystagmus test, struggling with balance and instructions during the Walk and Turn and One Leg Stand exercises, though she recited the alphabet without error. Based on these observations and traffic infractions, the patrolman placed her under arrest for driving under the influence. At police headquarters, she invoked her Miranda rights and refused to answer questions or submit to a breathalyzer test.
