A late-night traffic stop escalates when a driver, initially denying impairment, admits to consuming a seltzer mixed with vodka. The incident began in the early morning hours when an officer observed a 2008 Ford Escape driving erratically, crossing the center line, nearly rear-ending another vehicle, and exceeding the speed limit on a state route. Upon initiating the traffic stop, the officer immediately detected a strong odor of alcohol emanating from the vehicle and noted the driver's incoherent demeanor. Despite initial denials, the driver eventually admitted to consuming a Bud Light Seltzer with vodka approximately two hours prior to the stop. Given these clear indicators of impairment, the officer requested backup and proceeded to administer a series of voluntary field sobriety exercises. The driver struggled significantly, demonstrating a lack of smooth pursuit and distinct nystagmus during the Horizontal Gaze Nystagmus test. During the Walk and Turn test, the driver failed to complete the turn correctly and walked backward for the second set of steps. The One Leg Stand test also revealed impairment, as the driver struggled with balance and proper execution. A subsequent Preliminary Breath Test (PBT) indicated a blood alcohol content (BAC) of 0.125%, prompting the officer to place the driver under arrest for driving under the influence. After being transported to the detention facility, the driver waived constitutional rights and admitted to operating the vehicle while impaired. A later Alcotest confirmed a BAC of 0.111%, which is above the legal limit. The driver was formally booked and subsequently released on bail, later pleading guilty to an amended charge of Negligent Driving in the First Degree, a misdemeanor. The sentence included a period of supervised probation, community service, and substantial financial penalties, emphasizing the serious consequences of impaired driving.---Transparency through the lens of the law.
