#Bodycam #Miranda #PoliceBodycam - On July 22, 2025, airport police officers at Nashville International Airport (BNA) responded to Southwest Airlines Gate C23/C24 after a female passenger lay flat in the middle of the concourse walkway, waving both a New Zealand passport and a Canadian passport while showing signs of intoxication. When Southwest canceled her flight and an officer noted the odor of alcohol, she insisted that because she had undergone gastric sleeve surgery, it was medically impossible for her to get drunk. Despite officers spending more than seven minutes offering to escort her to the public side of the terminal without arresting her if she simply picked up her bags, she demanded that police carry her luggage, cursed at officers, threatened to kick an officer in the groin, and screamed repeatedly on the floor: "I'm American and I know the rights—why have you not given them to me?!" As officers placed her into a patrol cruiser in leg restraints, she claimed to practice "radical honesty" and asked to call both her husband in New Zealand and her boyfriend in the U.S. Army. ⚖️ LEGAL & CONSTITUTIONAL BREAKDOWN: • 49 U.S.C. § 44902(b) & 14 C.F.R. § 121.575(c) (Federal Refusal to Transport & Intoxicated Passenger Ban): Why airlines have sweeping federal statutory discretion to deny boarding to any passenger who appears intoxicated or inimical to safety. • Bariatric Physiology vs. "I Can't Get Drunk": Why sleeve gastrectomy actually accelerates gastric emptying and increases peak blood alcohol concentration from even a single drink. • Tennessee Code Annotated § 39-14-405 (Criminal Trespass), § 39-17-310 (Public Intoxication) & § 39-17-305 (Disorderly Conduct): How remaining inside a secure airport concourse after boarding is denied and obstructing pedestrian gate traffic establish probable cause for arrest under Atwater v. City of Lago Vista, 532 U.S. 318 (2001). • Miranda v. Arizona, 384 U.S. 436 (1966) & Rhode Island v. Innis, 446 U.S. 291 (1980): Why police are NOT required to read Miranda rights at the moment of handcuffing or arrest—warnings attach only prior to custodial interrogation. • Graham v. Connor, 490 U.S. 386 (1989) & T.C.A. § 39-16-602 (Resisting Arrest): Objective reasonableness of incremental restraint and leg shackles when an arrestee pulls away and kicks at officers. 🎓 EDUCATIONAL & FAIR USE DISCLAIMER: This video features authentic police body-worn camera footage obtained via public records requests and is presented with transformative legal commentary, statutory citations, and constitutional analysis under Section 107 of the Copyright Act of 1976 (Fair Use) for educational, journalistic, and legal instruction purposes.
