Around 2:56 AM on April 12, 2023, Officer Thomas Baden with the Tampa Police Department observed a white 2013 Lexus being driven without headlights in the vicinity of 15th Street North and 9th Avenue East. He activated his emergency lights to initiate a traffic stop, and the man driving the vehicle pulled over. However, his 18-year-old passenger immediately swapped seats with him after he got pulled over. Officers would later identify him as 19-year-old Ayden Franco, and they learned that he had a warrant for his arrest. As Officer Baden was speaking with the female in the driver seat, later identified as 18-year-old Angelica Penagos, he detected the odor of alcohol and observed other indicators of impairment. Angelica told him that they were coming from Showbar, and admitted to having a few drinks earlier that evening. Based on his suspicion of impairment and the fact that she was in physical control of the vehicle, Angelica was asked to exit the vehicle and perform field sobriety exercises. Officer Baden started with the Horizontal Gaze Nystagmus (HGN) test. The second exercise was the Walk and Turn test. During the Walk and Turn test, Angelica did not touch heel-to-toe on each step and turned improperly. The final exercise was the One Leg Stand test, and Angelica failed to raise her foot in the proper fashion and put her foot down before the test was complete. Based on her being in physical control of the vehicle, her indicators of impairment, the odor of alcohol, her admission to consuming alcohol earlier that evening, and her inability to adequately perform the field sobriety exercises, Angelica was placed under arrest for driving under the influence. Her passenger Ayden was also placed under arrest. A search of the vehicle incident to arrest yielded the presence of multiple controlled substances, along with a fake ID for Angelica. Angelica was transported by Officer Baden to the Orient Road jail for further processing. At the jail, she agreed to submit to a breath test. Her breath test results indicated BAC levels of 0.214% and 0.205%, which were more than double the legal limit of 0.08% for drivers over the age of 21. She was charged with a DUI with Property Damage or Personal Injury (316.193(4))) and eventually released pending her court appearance. ---------------------------------------------------- Please LIKE, SUBSCRIBE, and consider supporting this channel (email us for more information).
