He stopped the car near Runnymede. When he reached the driver, he learned her name was Patricia. As they spoke, he smelled alcohol and noticed signs that she might be impaired. Patricia said the Hyundai was a rental car and handed over her driver’s license. Officer Gonzalez returned to his patrol car to review her information. Because he suspected she had been drinking, he asked her to get out and complete field sobriety tests. The first test was the Horizontal Gaze Nystagmus, or HGN, assessment. Patricia then attempted the One Leg Stand. She had trouble raising her foot and put it down before the test ended. During the Walk and Turn, she failed to place her heel directly against her toe, made the wrong turn, and held her arms away from her body. Officer Gonzalez continued to smell alcohol on Patricia. She admitted drinking and had difficulty completing the tests. He arrested her for driving under the influence. Paneks Towing removed the Hyundai and held it for 12 hours under John’s Law. Officer Gonzalez then brought Patricia to the Essex Fells Police Department for processing. At the station, officers read Patricia the Standard Statement for Motor Vehicle Operators. She refused to provide breath samples. Once processing was complete, officers released her to a neighbor, who signed the Potential Liability Warning form for her. Patricia then received three traffic citations: driving under the influence, refusing a chemical test, and failing to use lighted lamps. On January 18, 2024, Patricia pleaded guilty to driving under the influence and refusing a chemical test. Under the plea agreement, prosecutors dismissed the charge for failing to use lighted lamps. Her guilty pleas required her to install an ignition interlock device in her car for nine months. She must also attend a 12-hour intoxicated-driver program and pay $1,130 in fines.
