Please like, comment, and SHARE! 🙏 🔍 Episode Overview: On December 18, 2022, at approximately 9:49 PM, officers from the Teaneck Police Department responded to a car accident involving a 2022 Kia SUV and a 2018 Dodge at the intersection of Queen Anne Road and Fort Lee Road. Officer Donejia Somerville arrived and noticed Bogota Police Officers Luciano and Hondros were already present. Officer Luciano informed her about the situation, and she then approached the driver who had been hit by the other vehicle. After he decided he did not need medical help, she spoke with 23-year-old Emily Mendez, the driver of the 2022 Kia. Around this time, Officer Alexander LaVacca and Sergeant Jason Hosey arrived to help. When Officer Somerville approached Emily, she noticed that Emily appeared annoyed and was not willing to respond to her questions. While questioning Emily, Officer Somerville smelled alcohol and asked her if she had been drinking. Emily denied having any alcohol within the past hour but would not share information about where she had come from. Officer Somerville, suspecting impairment, asked her to complete field sobriety tests. The first was the Walk and Turn test. During this test, Emily struggled to walk heel-to-toe and did not vocalize her steps. The second test was the One Leg Stand. In this exercise, Emily failed to lift her foot correctly and did not count out loud as instructed. Following the traffic accident, Officer Somerville arrested Emily for driving under the influence due to the smell of alcohol on her and her failure to perform the field sobriety tests properly. During the arrest, she became aggressive with Officer LaVacca and kicked Officer Somerville in the shin. Sergeant Hosey searched her vehicle but did not find any open alcohol containers. Officer Somerville then took Emily to the Teaneck Police Headquarters for processing. At police headquarters, Emily did not cooperate and declined to answer any questions. Officer Somerville read her the Standard Statement for Motor Vehicle Operators, but Emily still refused to provide breath samples for testing. Officer Andino-Doran recorded her refusal in the Alcotest machine. After processing, Emily was released to her sister, who signed the Potential Liability Warning form on her behalf. Emily received several summonses, which included charges of operating under the influence, refusing to take a chemical test, and reckless driving. She was also charged with Simple Assault under N.J.S.A 2C:12-1A(1). According to court records, on April 27, 2023, Emily pleaded guilty to both operating under the influence and refusing the chemical test. For these offenses, she was fined $640 for the operating charge and $690 for refusing the test. Additionally, she was required to complete 12 hours at an intoxicated driver resource center and use an ignition interlock device for three months. As part of her plea agreement, the charges for reckless driving and Simple Assault were dismissed.
