He followed the vehicle and pulled it over at 506 N Main Street, right across from the Whitman County Jail. The driver, 29-year-old Katie Jo Maurer, showed signs of being impaired. Katie informed the Deputy that she had attended the Beartooth concert in Spokane that evening. When asked if she had been drinking, Katie admitted to having had two drinks a few hours before. Deputy Miller offered her a chance to take voluntary field sobriety tests after she admitted to drinking alcohol. Deputy Petersen arrived shortly after to help with the traffic stop. The first test was the Horizontal Gaze Nystagmus (HGN), where Deputy Miller noticed that she couldn’t follow a moving object smoothly and showed signs of nystagmus when her eyes were at their maximum deviation. Next was the Walk and Turn test, which Katie could not perform correctly; she struggled to walk in a straight line and turned incorrectly. The last test was the One Leg Stand, where Katie was unable to keep her balance and counted to 23 while trying to stand on one leg for 30 seconds. After taking the voluntary field sobriety tests, Katie was asked to voluntarily undergo a preliminary breath test (PBT), which showed a blood alcohol concentration (BAC) of 0.113%. Given her admission of drinking alcohol, her poor performance on the field tests, and the PBT result, Deputy Miller arrested Katie for driving under the influence. Deputy Petersen allowed one of her sober passengers to take a PBT, which showed a BAC of 0.00%. As a result, they permitted him to drive Katie's vehicle instead of towing it. Katie was then taken to the Whitman County Jail for further processing, where she consented to a breathalyzer test. Deputy Miller informed Katie of her rights under the Implied Consent law, and she chose to answer questions, waiving her Miranda rights. After a 20-minute waiting period, Katie provided breath samples. The results from the Alcotest showed her blood alcohol concentration (BAC) was 0.089%, which is above the legal limit of 0.08%. She received a citation for driving under the influence according to RCW 46.61.502 and was taken to jail, as she could not pay the $500 bail before her DUI hearing.
